Your Freedom of Information request – MYM 59589
Dear Mr Citizen
Thank you for your email from the righttoknow.org.au website dated 28 November 2012, the body
of which contained the following words.
Please report on all erroneous tax refunds to Hong Kong bank accounts exceeding $1
million.
The
Freedom of Information Act 1982 (FOI Act) creates a right for you to make a request for a
document and when you do that we are obliged to look for the document and send a copy to you.
We are not obliged to create reports or to provide answers to research questions. That said, we
are obliged to take reasonable steps to assist you to make your request in a way that conforms to
the FOI Act. In this case I have taken your request to be asking for any document we have in our
possession about tax refunds made in error to Hong Kong bank accounts over $1 million.
I have asked the relevant area in the ATO to take reasonable steps to investigate. As we received
your request on 28 November 2012 and as the 30 day statutory period for processing your request
commenced from the day after that date, you should expect a decision from us by 28 December
2012. The period of 30 days may be extended if we need to consult third parties or impose a
charge or for other reasons. We will advise you if this happens.
You will be notified of any charges in relation to your request as soon as possible and before we
process any requested documents or impose a final charge.
