Freedom of Information Request
I refer to your request received
22 December 2017 for access to documents relating to the
salaries IP Australia’s SES officers under the
Freedom of Information Act 1982. I have taken
your request to be for:
“…documents which detail the precise salary paid to each of the Office of the
Australian Information Commissioner’s (OAIC’s)[as per your request this is read as a
reference to IP Australia] SES officers in the following financial years - FY2014/15, FY
2015/16 and FY2016/17. That information might be included in the group
certificates/end-of-year PAYG payments summaries issued by the OAIC to its SES
officers, or common law contracts relating to the employment of the relevant SES
officers or, any relevant determinations made under subsection 24(1) or 24(3) of the
Public Service Act 1999 in respect of those relevant SES officers or, perhaps a
document prepared pursuant to s.17 of the FOI Act.”
As your request covers documents which contain personal information, IP Australia is
required to consult with the individuals (under section 27A of the FOI Act) before making a
decision on the release of those documents.
For this reason the period for processing your request has been extended by 30 days in
order to allow our agency time to consult with that individual (section 15(6) of the FOI Act).
The processing period for your request wil now end on
20 February 2018.
The consultation mechanism under section 27A applies when we believe the individual (or
their representative) may wish to contend that the requested documents are exempt for
reasons of personal privacy. We will take into account any comments we receive from the
individual but the final decision about whether to grant you access to the documents you
requested rests with IP Australia.
You will be notified of any charges in relation to your request as soon as possible, before we
process any requested documents or impose a final charge.
Please note that information released under the FOI Act may later be published online on
our disclosure log subject to certain exceptions. (For example, personal information will not
be published where this would be unreasonable.)
