Review in response to your Freedom of Information request
I refer to the Office of the Australian Information Commissioner (IC) review (MR18/00628) of
the Department of Human Services’ (
department) internal review of charges decision,
notified to you on 24 July 2018 (LEX 37804). The charges decision was in relation to your
request (LEX 35790), dated 22 March 2018, for access to documents held by the
department, under the
Freedom of Information Act 1982 (
FOI Act), made in the following
terms:

Background
On 9 April 2018, the department notified you of a preliminary assessment of charges for the
processing of your request (
preliminary charge).
On 28 April 2018, you requested reconsideration of the preliminary charge.
On 29 May 2018, the department notified you of its reconsideration of charges decision,
which affirmed the preliminary charge.
On 24 June 2018, you requested internal review of the reconsideration of charges decision.
On 24 July 2018, the department notified you of its internal review of charges decision, which
affirmed the reconsideration of charges decision.

Section 55G Decision
I have considered afresh the department’s internal review of charges decision to impose a
charge of $14.55.
In accordance with section 55G(1)(b) of the FOI Act, I have decided to set aside that internal
review of charges decision.
The effect of setting aside the charges decision is that you are relieved of the liability to pay a
charge in respect of your request. The department will now proceed to provide you with a
decision on access and will notify you of this decision by no later than
19 November 2018.
