FREEDOM OF INFORMATION: NOTICE OF THIRD PARTY CONSULTATION
I refer to your request submitted under section 30 of the
Freedom of Information Act
2016 (the Act), received by the Chief Minister, Treasury and Economic Development
Directorate (CMTEDD) on 20 June 2019.
Specifically, you sought:
“all documents held or produced by ACT Government related to
the new home of footbal in Throsby announced in this year's budget - including, but not
limited to:
• correspondence within ACT government about this budget measure;
• correspondence between Capital Footbal and ACT government about this budget
measure;
• correspondence with any other party/ies and ACT government about this budget
measure;
• documentation about the proposed physical location within Throsby of this home
of football.”
Authority
In accordance with section 19(2) of the Act I have been delegated functions of an
Information Officer in relation to the administration of part 5 of the Act except for those
powers limited under subsection 19(3).
Consultation
Information identified as relevant to your request involves two third parties. These third
parties may be concerned about the release and publication of the identified information.
Under section 38 of the Act, I am obliged to seek third party views on the release of the
information concerning them and, under section 40 of the Act, provide a period of 15
working days for them to submit reasons favouring non-disclosure if they wish to do so.
The revised deadline for a response to your request is 8 August 2019.

Further action
Third party consultation has commenced. Should the relevant third parties disagree with
my determination on the release of government information in response to your request,
access to that information may be deferred to facilitate an external review process and
you will be notified accordingly.

Privacy Act 2014 and wil not be provided to the relevant third parties without your prior
consent.
