Sham contracting 
Key messages 
•  The FWO is the most appropriate agency to handle sham contracting matters; 
•  FWBC will continue to investigate sham contracting when it is a part of an investigation with 
primary contraventions that are within FWBC’s regulator priorities. 
 
Changes 
On  3 December 2013,  FWBC and FWO agreed for FWO to take carriage of wages and entitlement 
matters. In some cases, this will include sham contracting cases. 
 
Current data 
•  The last sham contracting investigation was launched on 28 November 2013; 
•  FWBC first referred a sham contracting matter to FWO (informally) on 4 December 2013;  
•  FWBC has since formally referred 0 sham contracting matters to FWO. 
•  FWBC has had 46 inquiries into sham contracting since 3 December 2013. Inquiries relating 
exclusively to sham contracting are informally referred to the FWO.
