Decision notice on your access application
I refer to your access application made under the Freedom of Information Act 2016 (FOI
Act), dated 25 September 2020. This application requested access to: “documents held by
the Commission in relation to the 2020 electronic voting system. Specifically…the
independent audit certificate, the independent audit certificate report, and any other
document on which the commissioner based his assessment that the program will not
allow a person to find out how a particular elector cast his or her vote.”
Authority
I am an officer authorised by the ACT Electoral Commissioner to make decisions about
access to public sector information, in accordance with section 18 of the FOI Act.

I have identified eight documents containing information within the scope of your access
application. These are outlined in the attached Schedule of documents.
I have decided to:
◼ grant full access to 4 documents
◼ grant part access to 4 documents
For the reasons outlined in the attached Reasons for decision, I have refused access to
some of the information that you have requested under section 35(1)(c) of the FOI Act.
This is because it is contrary to the public interest information.
