Notice of Extended Timeframe due to Third Party Consultation
I refer to your email received by the Australian Securities and Investments Commission
(
ASIC) on 26 October 2020 in which you seek access to the following under the
Freedom of
Information Act 1982 (Cth) (
FOI Act):
The document I seek is a copy of advice provided to James Shipton on 11 October 2018 that
the full amount for professional advice by KPMG on personal taxation matters for James
Shipton would be paid by ASIC.
Personal Information – Consultation Process (s 27A of the FOI Act) As your request covers a document which contains the personal information of Mr Shipton,
ASIC is required to consult with Mr Shipton (under section 27A of the FOI Act) before
making a decision on the release of the document.
For this reason the period for processing your request has been extended by 30 days in
order to allow ASIC time to consult with Mr Shipton (section 15(6) of the FOI Act). The
processing period for your request will therefore end on 25 December 2020. As 25
December 2020 is a public holiday, the due date is extended to
29 December 2020, being
the next day that is not a Saturday, Sunday or a holiday.1
The consultation mechanism under s 27A applies when we believe that the individual
concerned may wish to contend that the requested document is exempt for reasons of
personal privacy. We will take into account any comments we receive from Mr Shipton but
the final decision about whether to grant you access to the document you requested rests
with ASIC.
