Good afternoon Peter,
As you may already be aware from advice provided to staff at the APSC late last week and earlier this week, the
ATO has been attempting to work through a dispute with the Australian Services Union (ASU) regarding
current working from home arrangements resulting from the pandemic. s. 22
The ATO holds a different view to the ASU, in that our COVID working from home arrangements:
  *   were put in place to comply with Government directions and to protect our staff;
  *   covered classes of employees that are not covered by the relevant clauses of the ATO EA (such as our
casual and non-APS staff);
  *   were always designed to be temporary rather than the longer term, business as usual arrangements
contemplated in the ATO EA;
  *   provided (in practice) similar protections to our EA, and
  *   utilised completely different processes than our “normal” work from home agreements.

APS agencies should follow all relevant laws and directions, including jurisdictional requirements.
The Victorian Government’s position is that employees who have been working from home in
Victoria should to continue doing so for the time being. This will not affect employees who have
continued to attend usual workplaces, but should be considered by the ATO in transition plans
for return to usual workplaces in Victoria.
There is no change to the APSC Circular 2020/5 as it discusses that agencies should be flexible in
developing transition plans as they will be required to respond and adapt to advice from state
and territory governments. Where agencies have employees located in Victoria their transition
plans will need to take into account the direction from the Victorian Premier.

2.  Further to advice from the Chief Medical Office, the ATO has implemented working from
home arrangements for over 11,000 of our staff and has also implemented social
distancing guidelines for those employees who are still coming in to the office.
3.  Ensuring ATO information and data remains within secure and approved channels is vital
for our operational security and adherence to privacy legislation. As such, the same
policies and principles are adhered to when working outside of the office, as they would
be when working inside of the office. We have been very clear in ensuring our staff remain
aware of the importance of security, privacy and secrecy requirements. This also means
