Notice of extended timeframe – third party consultation required
Dear Mr Sweeney
I refer to your request submitted to the Fair Work Ombudsman (FWO) on 15 April 2021 under the
Freedom of Information Act 1982 (FOI Act) for:
“copies of correspondence from the National Australia Bank to the Fair Work Ombudsman advising of
such underpayments.”
Requirement to consult with third parties
The FWO has identified documents within the scope of the request that contain information about
business, commercial or financial affairs of an organisation.
In accordance with section 27 of the FOI Act, the FWO is required to consult with the relevant
organisation before deciding whether to release the information to you.
Please advise whether you consent to being identified as the FOI applicant to the third party for the
purpose of consultation. You do not have to consent, however your consent to be identified as the FOI
Applicant wil assist the third party in arriving at a decision regarding release of the documents. We
note that you are currently identified as the applicant on the Right to Know website which is accessible
to the third party.
We wil take into account any comments we receive, however the final decision about whether to
grant access to the documents which are the subject of your request rests with the authorised
decision-maker on behalf of the FWO.
Further processing of your request
To enable the consultation with the affected third party to occur, the statutory period for processing
your FOI request is extended by thirty (30) days. This extension of the due date is made in accordance
with section 15(6) of the FOI Act.
