FREEDOM OF INFORMATION (FOI) REQUEST
I refer to your application under the
Freedom of Information Act 2016 (the FOI Act)
received by the Education Directorate (the Directorate) on 20 August 2021, in which you
are seeking access to:
‘Documents regarding the decision making process and final decisions regarding
student assessment during the remote learning period of 2021 (which started
specifically on the 20th of August, 2021). Specifically, documents containing decisions
regarding whether students wil be assessed similarly to the remote learning period in
2020, where they received an "S" grade for that school semester.’

Studies (BSSS) service responsibility; for more details please see this link to their

function of the BSSS is to provide information on the performance of students and former
students and to establish the principles and procedures for the assessment of
attainments of students and the moderation of these assessments.
With BSSS support, the Education Directorate’s FOI office is undertaking the management
and processing of your request.
In accordance with section 40 of the FOI Act, a decision on access to the information
requested is due 20 working days from receipt, being 17 September 2021. However, if
third party information is involved, we may be required to consult with third parties and
the decision date will be extended by a further 15 working days. You will be informed if
this action is required.
Please be aware that FOI request timeframes may be impacted by COVID-19, and whilst
we are continuing to work to meet statutory timeframes, this may not be possible in al

Open Access Information
The Act requires that details regarding access requests such as the application, decision
notices, and information released, must be recorded in the agency’s disclosure log and be
made publicly available between three and ten working days after a decision on access
