Request for access to documents under the Freedom of Information Act 1982
I refer to your Freedom of Information Act (FOI Act) request sent and received 3 September
2021, in which you sought access to “…any report/advice/doc issued to advise public that
the cdc recalled pcr tests as they are deemed unreliable to confirm sar-cov2 when cycled
above 24 false positives of 50-80%”.
Authorised decision-maker
I confirm that I am an authorised decision maker within the meaning of section 23 of the FOI
Act.
Material taken into account
I have taken the following material into account in making my decision on access:

your request
•
the FOI Act; and
•
the guidelines issued by the Australian Information Commissioner under section 93A
of the FOI Act.
Decision on access
I have decided to refuse your request for documents identified in your FOI request in
accordance with subsection 24A(1) of the FOI Act.
Subsection 24A(1) provides as follows:
‘An agency or Minister may refuse a request for access to a document if:
(a) all reasonable steps have been taken to find the document; and
(b) the agency of Minister is satisfied that the document: (i) is in the agency’s
or Minister’s possession but cannot be found; or (ii) does not exist.’
The reasons for my decision, the findings on material questions of fact and the material on
which those findings were based are set out below.
I have arranged for searches to be conducted of the ACMA’s various electronic file
management systems, using the terms and subject matter supplied in your request, and no
documents within the scope of your request were located.
The ACMA is responsible for the regulation of broadcasting, the internet,
radiocommunications and telecommunications in Australia, in accordance with the functions
and responsibilities set out in Part 2 of the
Australian Communications and Media Authority

Act 2005. The documents sought have no connection to the operations of the ACMA. I am
satisfied that all reasonable steps have been taken to find any relevant documents that might
fall within the scope of your request, and that no documents exist that fall within the scope of
your request.
