Dear Mr Tannahill,

We are writing in relation to the request you made under the Freedom of Information Act 1982 (FOI
Act) to the eSafety Commissioner (eSafety) on 29 September 2021 (FOI request).

We would like to discuss and seek further information about your request.

The wording of your FOI request is for:
•  ‘Correspondence, including emails, whether internal to the office or between the
office and outside parties;
•  diary entries, calendar entries, and notifications of online meetings;
•  minutes of meetings; and
•  discussion of policy, and any draft or final policy papers or proposals;
where those documents discuss or relate (in whole or in part) to:
•  the proposed involvement of Mastercard, or any individual or entity closely related to
Mastercard, in delivering or influencing the delivery of online age verification services
in Australia;
covering the period:
•  beginning 1 February 2020, immediately prior to the release of the "Protecting the
Age of Innocence" report;
•  ending a week prior to your final response to this FOI request.’
We note that your request is not clearly defined in some parts. For example, eSafety is not in a
position to determine whether an individual or entity is closely related to Mastercard. Further, the time
period for your request cannot include future dates. Therefore, we are seeking to clarify the scope and
timeframe of your request in order to move forward with your request.

We also note that the Protecting the Age of Innocence report was a report of the Standing Committee
on Social Policy and Legal Affairs. As such, eSafety does not hold documents that were submitted as
part of that process.
Suggested scope
In order to assist us process your request, we have suggested possible ways of refining the scope.
It is suggested that the scope be refined to documents within the time period of 1 February 2021, as
outlined in your request, and 29 September 2021, the day of your request.
It is also suggested that the scope of your request be on documents that discuss or relate (in whole or
in part) to the proposed involvement of Mastercard in delivering or influencing the delivery of online
age verification services in Australia.
We would also welcome the opportunity to discuss your FOI request with you, if that would assist.

Please contact the FOI Coordinator at xxx@xxxxxxx.xxx.xx to let us know your thoughts on our
suggested ways of refining your request or with any questions.
Kind regards,

FOI Coordinator
eSafety Commissioner
