Freedom of Information Request The purpose of this letter is to acknowledge receipt of your request under the
Freedom of Information
Act 1982 (Cth) (FOI Act) that the eSafety Commissioner (eSafety) received on 29 September 2021.
Thank you for corresponding with eSafety to assist in clarifying your request, as outlined below.
Scope of your request
I understand your request is for:
• ‘Correspondence, including emails, whether internal to the office or between the office and
outside parties;
• diary entries, calendar entries, and notifications of online meetings;
• minutes of meetings; and
• discussion of policy, and any draft or final policy papers or proposals;
where those documents discuss or relate (in whole or in part) to:
• the proposed involvement of Mastercard, or any individual or entity closely related to
Mastercard, in delivering or influencing the delivery of online age verification services in
Australia;
covering the period:
• 1 February 2020 to 7 October 2021.’
I understand your request relating to any individual or entity closely related to Mastercard refers to
‘employees and representatives of Mastercard, or employees or representatives of companies or
organisations that are, to the Commissioner's knowledge, subsidiaries or subcontractors of
Mastercard.’
As discussed, I confirm that eSafety will interpret this as referring only to the names of people eSafety
is aware (to the best of our knowledge) represent Mastercard or names that appear on a document in
eSafety's possession related to, or which references, Mastercard, where those names relate to
Mastercard. eSafety will then conduct a further search of its documents in relation to those names.
I also understand your request does not refer to publicly available information or news articles.

Charges The processing charges which eSafety is entitled to charge are prescribed in the
Freedom of
Information (Charges) Regulations 2019. These charges include:
•
searching and retrieving ($15 per hour)
•
making a decision on access ($20 per hour after the first five hours, which are for free)
•
photocopying a written document (10 cents per page)
•
making a copy of a written document other than a photocopy ($4.40 per page)
•
postage or delivery (an amount not exceeding cost of postage or delivery)
•
transcribing ($4.40 per page)
•
supervising, if the applicant wishes to inspect ($6.25 per half an hour, or part thereof).
eSafety will, in accordance with section 29 of the FOI Act, advise you if you are liable to pay any
charge and provide a preliminary assessment of those charges.
Timeframe for processing eSafety received your request on 29 September 2021 and the 30-day statutory period for processing
your request commenced from the day after that date. The 30-day statutory period for processing your
request concludes on 29 October 2021.
However, the FOI Act provides for an extension of time in certain circumstances. Relevantly, the time
period can be extended by 30 days if third party consultation is required. I will inform you if the time
period needs to be extended pursuant to the FOI Act.
