5. Clearance
Searches
To satisfy the FOI Act, the agency requires confirmation that all reasonable searches have
been undertaken. As this is a significant matter it is expected that the General Manager of

On 13 July 2021, Services Australia received a significant freedom of information request from Mr Fraser Tweedale,
seeking access to source code and technical documentation for the myGov Code Generator application.
The Experience and Data Services Division advised the requested documents are not suitable for release.

A decision has been prepared refusing access in full to all documents as they contain information that would, or
could reasonably be expected to, have a substantial adverse effect on the proper and efficient conduct of the
operations of Services Australia (section 47E(d)).
As any decision would be published on the Right to Know website, we asked the business area to review the
decision (specifically the description of the documentation, the program and the risk) and confirm they were
comfortable with the descriptions and information contained within. Approval of the decision wording was received
from the Division on 12 August 2021 (copy attached).
A decision is currently due for notification on 13 September 2021.

Submissions made by applicant -
In response to 47E(d) exempting the documents, and the concern that the code generator app may be
counterfeited - applicant submits that the app could be counterfeited without the information. Applicant
submits that even if a counterfeit application was created, how would it be distributed (installed on devices)
where apps distributed via app stores are allegedly vetted to some degree. Also notes that app stores
communicate the publisher of the app, with mygov being identified as published by Services Australia on the
app store.
Applicant alleges that the app stores prohibit applications that impersonate other applications.
Summary of argument given is:
• Source code and technical documentation are not prerequisites to de-veloping a counterfeit application.
• The “app store” distribution model provides signicant safeguards and recourse against counterfeit
applications. These safeguards are at work, and recourse against counterfeit applications may have to be
taken, whether or not the myGov Code Generator source code or technical documentation is available to
the public.
• End users wil overwhelmingly download the myGov Code Generator application from app stores. It is
reasonable to expect that users who install it from other sources are advanced users who would take steps
to authenticate the application bundle before installing and using it.
2nd part of applicants submissions relates to original decision assertion that if released, it can be reasonably
expected that the documents would lead to abuse of information & have an adverse effect on the agency's
operations. Applicant submits that it is not reasonable to assume that release would cause a substantial
adverse effect as the app should have in-built security or development preventing this.
Applicant submits that it is not a prerequisite to obtain code and technical documentation to find
vulnerabilities in software.
3rd submission is that the original decision does not adequately identify the particulars of the predicted
effect & that the reasons given were generical y for all documents rather than individual documents.
Applicant submits that there are a number of public interest factors for release that were not mentioned in
the original decision.
Further applicant submits that for members of public who cannot or wil not access the mygov app via the
apple or google play stores that this is unfair and releasing the code will allow for other apps to be created.
DTA guidelines that state government code should be released unless there is a compelling reason. exerpt
included that says code should be released if it does not release private and secure data.
