FREEDOM OF INFORMATION (FOI) REQUEST
I refer to your application under the
Freedom of Information Act 2016 (the Act) received
by the Education Directorate (the Directorate) on 13 January 2022, in which you are
seeking information access to:
Documents including but not limited to emails, text messages or briefs with
information about the supply of RATs to ACT Ministers or their offices by the ACT
Education and Training Directorate in the months December 2021 and January
2022.
On 17 January an email was sent seeing clarity to your scope as it was ambiguous in its
meaning. On 24 January your email was received (sent 10:30 PM Friday 21 January) which
confirmed your scope to be:
Documents including but not limited to emails, text messages or briefs to ACT
Ministers or their offices by the ACT Education Directorate in the months
December 2021 and January 2022 about the supply of RATs to those offices or
their ministers.
With the additional information that
‘for clarity this is about the supply of RAT Tests for
the use of those offices.’ Thank you for this explanation of your scope.
The Directorate is processing your request and in accordance with section 40 of the FOI
Act, we will provide you with a decision on access to documents within the terms of your
request, within 20 working days of receipt, being 22 February 2022.
Please be aware that FOI request timeframes may be impacted by COVID-19, and whilst
we are continuing to work to meet statutory timeframes, this may not be possible in al
instances. We are committed, to working with you to respond as best we can under the
current circumstances. We thank you for your patience and understanding during this
time and will notify you if a delay becomes necessary.

Third Party Consultation
In processing your application, consultation with relevant third parties may be required. If
this is the case, you wil be notified to this effect and advised of a revised decision due
date in respect of your application. In line with the Act, if third party consultation is
required, the due date is extended by 15 working days.
Open Access Information
The Act requires that details regarding access requests such as the application, decision
notices, and information released, must be recorded in the agency’s disclosure log and be
made publicly available between three and ten working days after a decision on access
has been given to the applicant. Please be aware that your personal information, such as
your identity and contact details, wil be withheld from publication.
