Request for access to documents under the Freedom of Information Act
1982
I refer to your request under the
Freedom of Information Act 1982 (the FOI Act)
received by the Australian Communications and Media Authority (the ACMA) on
8 March 2022 in which you sought access to:
“the current Declarations of Public Interest documents or the equivalent
current public interest disclosures for:
Nerida O'Loughlin
Creina Chapman
James Cameron
Chris Jose
Fiona Cameron
Anita Jacoby
Delia Rickard
Anna Brakey”.
I assume, from that description, that you want access to the current declarations
or disclosures of interests made by those persons individually in compliance
with their statutory obligations, which help to identify and manage any conflicts
of interest in a way that serves the public interest. Please let me know if my
assumption as to the scope of your request is incorrect.
If you want access to other documents, you will need to give sufficient
information to enable the ACMA to identify those documents. In that case, I will
consider any further information you give and, if I am satisfied that your request
does not sufficiently identify the documents sought, I will, in accordance with
paragraph 24(1)(a) and section 24AB of the FOI Act, undertake a consultation
process to assist you to revise your request.

Charges
The charges which the ACMA is entitled to impose in respect of a request for
access to a document and provision of access to a document are set out in the
Freedom of Information (Charges) Regulations 2019. They include charges for:
• the time spent in searching for, or retrieving, a document ($15.00 per
hour);
• the time spent in making a decision on a request for access to a
document ($20.00 per hour after the first 5 hours which are for free);
• photocopying a written document (10 cents per page);
• making a copy of a written document other than a photocopy ($4.40
per page); and
• postage or delivery of a copy of a document (an amount not
exceeding the actual costs for postage or delivery).
I note that you have requested waiver of all charges, and I will give due
consideration to that request. If the ACMA does decide that you are liable to
pay any charge, the ACMA will, in accordance with subsection 29(1) of the FOI
Act, notify you of the decision and the ACMA’s preliminary assessment of the
charge.
Timeframe for processing
The statutory timeframe for processing a request under the FOI Act is generally
30 days after the day on which the request is received.
The ACMA will, in accordance with subsection 15(5) of the FOI Act, notify you of
a decision on your request as soon as practicable but in any event by 7 April
2022, unless the timeframe is extended under the FOI Act.
