I refer to your email of 9 April 2022 in which you made a request to the Department of the 
Prime Minister and Cabinet (the Department) under the Freedom of Information Act 1982 (the 
FOI Act) in the following terms: 
 
Please accept our request for information in accordance with the FOI Act.  
1.  Please provide a copy of the department's procedures for determining breaches of the 
APS Code of Conduct and the imposition of sanctions that is currently in force.  
2.  Please also provide a copy of the procedures that would have been in force in 2012.

I have decided to grant access to the requested documents in full, with irrelevant information

In making this decision, I have had regard to the following material:  
• 
the FOI request; 
• 
the requested documents; 
• 
the FOI Act; and 
• 
the ‘Guidelines issued by the Australian Information Commissioner under section 
93A of the Freedom of Information Act 1982’ (FOI Guidelines).  
 
My reasons for decision are set out below. 
 
Reasons for decision 
 
The requested documents are the Department’s procedures for determining breaches of the 
APS Code of Conduct that are currently in force, and those that were in force in 2012.   
 
Please note that the Department also publishes its current procedures for determining breaches 
of the APS Code of Conduct on its website at https://www.pmc.gov.au/resource-
centre/government/procedures-determining-breaches-aps-code-conduct-and-imposition-
sanctions.  
 
Deletion of irrelevant matter 
 
Section 22 of the FOI Act relevantly provides that if giving access to a document would 
disclose information that would reasonably be regarded as irrelevant to the request, and it is 
possible for the Department to prepare an edited copy of the document, modified by deletions, 
ensuring that the edited copy would not disclose any information that would reasonably be 
regarded as irrelevant to the request, the Department must give the applicant access to an 
edited copy.  
 
On 11 April 2022, the Department advised you of its policy to exclude the personal and direct 
contact details of officers not in the Senior Executive Service (SES) and any Ministerial staff, 
as well as any person’s signature, and the mobile or direct numbers of SES officers, which are 
contained in documents that fall within the terms of an FOI request. This category of 
information is identified as irrelevant and documents can be modified by the Department to 
delete the irrelevant material.  
 
Accordingly, I am satisfied that parts of the requested documents are irrelevant under section 
22(1)(a)(ii) of the FOI Act. The remainder of the requested documents are released to you as 
they are relevant to your request. 
 
Processing and access charges 
 
I have decided not to impose processing charges in respect of the applicant’s request. 
 
Publication of Documents  
 
Under section 11C of the FOI Act, the Department will make arrangements to publish the 
documents released to you on the Department’s FOI Disclosure Log on the Department’s
