On 15 April 2022 you wrote to the Australian Electoral Commission (
AEC) seeking
access under the
Freedom of Information Act 1982 (the FOI Act) to:
•
EasyCount Senate NATA Accreditation Report.
While your request was deemed to have been refused on 15 May 2022, I have
proceeded to process the application in line with the guidance at paragraph 3.161 of
the guidelines issued by the Australian Information Commissioner under section 93A
of the FOI Act.
Revocation of decision given on 9 September 2022
As outlined in my covering letter to this attachment, the decision notified in my letter
to you dated 9 September 2022 referred to an irrelevant consideration and
accordingly is revoked.
I make the following decision in substitution for that notified in my letter to you dated
9 September 2022.
Revised decision
Identification of Documents
I identified one document that fell within the scope of your FOI request (the ‘Relevant
Document’). I did this by contacting the relevant business areas and requesting a
copy of all relevant documents.
Decision
With regard to the Relevant Document I have decided:
(a)
that the document is conditionally exempt under section 47E of the FOI Act;
(b)
that it is contrary to the public interest to give access in full to the Relevant
Document;
(c)
it is possible and practicable having regard to the resources available to the
Australian Electoral Commission to produce an edited copy of the Relevant
Document from which exempt material has been redacted; and
(d)
to give you access to the edited copy of the Relevant Document in lieu of the
original.
I have directed that an edited version of the Relevant Document be prepared in
accordance with my decision.

Attachment B.
