I write with respect to your email dated 18 January 2023, requesting a waiver of the charges
notified for the processing of your request to access documents under the
Freedom of
Information Act 1982 (the Act).
Decision
On 16 January 2023 I advised that I consider you are liable to pay a charge under section 29
of the Act in respect of your request. On 18 January 2023 you replied, contending the charge
should be waived.
I have considered your submissions, as well as the matters at section 29(5) of the Act. For the
reasons given in my earlier letter, I remain of the view that the charge as assessed is
appropriate.
Your options
The Act requires you to exercise one of the following options within 30 days of receipt of my
decision:
• agree to pay the charge and make payment in full, or pay the deposit of $152.
• seek review of my decision
• withdraw your FOI request.
Details of how to pay were provided to you in my letter of 16 January 2023.
Review rights
If you disagree with the decision you may apply for an Information Commissioner review
within 60 days from the date of this letter. The FOI Act does not provide for internal review
of a decision by Minister.
