Freedom of Information request finalised without being processed 
I refer to your request to the Victorian Electoral Commission (VEC) on 1 December 2022 for 
access to documents under the Freedom of Information Act 1982 (Vic) (FOI Act) and our letter of 
12 December 2022. 
In that letter you were informed that the application fee had not been paid and sufficient information 
had not been provided that would al ow the VEC to objectively identify the documents you sought.  
You were asked to pay the application fee and invited to consult with the VEC, within 21 days, with 
a view to amending or clarifying the terms of the request so that it was in a form which complied 
with s 17 of the FOI Act. Without that payment and further information, the request was not valid 
under the FOI Act. 
It has been more than 21 days since that letter was sent to you, and the VEC has not received 
payment of the application fee or a response from you indicating an intention to consult and amend 
or clarify your request. 
Accordingly, as you have been provided with a reasonable opportunity to pay the application fee 
and consult with the VEC, and there has been no change to the request, I have decided to refuse 
to respond to the request on the basis that it does not comply with s 17 of the FOI Act. The VEC 
now considers your FOI request as having lapsed.
