Dear Kellie-Ann,
I have received four nominations from senior Advocates who have had between 10 to 23 years
practical experience with claims under the current three Acts, and Multi-Act claims, and have a
very good understanding of the processing and problems associated with Multi-Act claims
specifically.
 
Through their many years of experiences they are all well qualified and capable of providing
positive comments and suggestions/recommendations as to how advocates and the Department
cand best work together in respect of multi-act claims, and taking part and contributing
positively in any discussions on processing, or any potential policy issues.

 
I have listed their names hereunder, with some details of their Advocacy experiences. I have
listed them in s 47G
s 47F, s 47G
 
We believe that any one or more of those of the Advocates mentioned could (should) be
selected to participate in the Working Group and would, in light of their experiences, provide
well informed comments/suggestions on the subject issue. We leave the ultimate decision in
your hands as to whom you consider is the most appropriate person to participate in the
Working Group as a representative of the s 47G Their input, we believe would most certainly be
beneficial to the formation of appropriate recommendations that will no doubt define/refine the
processes for determination of multi-Act claims to the benefit of DVA and the Veterans’
community generally.

 was nominated for this working group because of his long and deep


experience with the ATDP and as an advocate.  s 47F is a practising advocate well versed
in all three veterans’ acts and is an ATDP instructor.
 
We consider that the inclusion in the working group of s 47F
 will add value to the
Group, even at the expense a of an additional member.  Please advise if any further
information is required.
 
The Association asks that the business area review favourably its decision on this matter.

We are seeking nominations for experienced advocates to become members of DVA’s Multi-Act
claims working group.
 
At the last ESORT meeting on 26 November 2020, action item 2020/0049 arose, ‘ESORT


Secretariat to seek, from ESORT members, nominations for advocates with appropriate
experience to assist DVA to define and refine processes for determination of multi-Act Claims.’
.
 
Grateful for your nomination to be received by ESORT Secretariat, no later than COB Tuesday 19
January 2021. The working group will be capped at 5 representatives.

including information regarding how it will be conducted – this information needs to be provide by the BA for the email.
·         BA to draft agenda and any information papers.
·         Secretariat will provide Tech Support, but will not be taking minutes for the meeting.  This is up to the BA to provide a minute taker.

Thank you for advising that the 6 nominations have been accepted and the endorsement of the working group through the cleared Terms of Reference (ToR)
Would you be able to touch base with Natasha and advise the time and date that would be suitable for her to convene the first working group  The secretariat will then go out
to members to confirm this is suitable and then send out the meeting invites, including the GovTeams link
Would you also be able to advise any other DVA attendees to be added to the invite
As Secretariat, we can support the Working Group by contacting ESORT members to seek participants and set up the videoconference
It will be up to the business area to provide any papers required to facilitate the working group and also to take minutes/meeting notes at the meeting (if required)  It is
anticipated that the relevant business area will provide time and dates suitable to the chair, for the secretariat to then go to externals confirming suitability

Transitional Provisions 
 
It is important to have clarity about the legislative landscape that applies to the work of the claims 
registration team in order to understand the operating protocols for that particular team and some of 
the challenges associated with claims registration. Many of these challenges, if not resolved 
effectively, can result in downstream complications for the claimant and DVA. 
 
The MRCA ‘Transitional Provisions’ are contained within the Military Rehabilitation and Compensation 
(Consequential and Transitional Provisions) Act 2004
, which also amended certain provisions of the 
VEA and the DRCA when it was enacted. When discussed in certain contexts, the MRCA Transitional 
Provisions are often spoken about in a way that sounds like their application involves the exercise of 
discretion or choice on behalf of the delegate or DVA. However, these provisions prescribe when the 
MRCA applies to a claim and when it does not, and involve the application of legislative provisions and 
the consideration of evidence in a way similar to many other elements of the compensation claims 
process. 
 
It should be noted however that while the Transitional Provisions prescribe whether or not the MRCA 
applies to a claim and closes off the VEA and the DRCA to certain claims, they do not prescribe how a 
person might claim under those Acts. A person may lodge a claim believing they are covered under 
the MRCA but the Transitional Provisions may rule out any valid application of that Act to the claim 
based on the evidence available. In such circumstances, the likely and proper outcome would be a 
rejection of the claim with reference to relevant Transitional Provisions.  This does not affect the 
validity of the claim itself and it stands as one that needs to be investigated and determined. 
 
Whether the MRCA applies to a claim or not is determined by whether service rendered on or after 
1 July 2004 relates to the onset (based on the MRCA heads of liability, which are primarily causal) of 
the injury or disease claimed1. Where the onset of the claimed injury or disease relates to service 
rendered on or after 1 July 2004, then the MRCA applies to the claim and the VEA and the DRCA 
cannot. The onset claimed injury or disease does not have to relate solely to service rendered on or 
after 1 July 2004; that is, where there is evidence service rendered before 1 July 2004 also relates to 
the claimed injury or disease, as well as service rendered on or after 1 July 2004, then the MRCA still 
applies to the claim, and the VEA and the DRCA do not. 
 
The diagram below illustrates that where an injury or disease has onset after 1 July 2004 and the 
service that relates to that injury or disease spans 1 July 2004, the MRCA will apply to that injury or 
disease, and not the VEA or the DRCA.

Current processes depend heavily on date of onset of the injury or disease and the service history of 
the claimant. That is, where clinical onset is on or after 1 Jul 2004 and the claimant has rendered 
service on or after 1 July 2004, current procedures assume that this claim should be initially registered 
under the MRCA (exceptions are outlined below). However, just because a person has rendered 
service on or after 1 July 2004 does not mean that service is related to the claimed injury or disease, 
even where onset is on or after 1 July 2004. For example, the MRCA would not apply to a claim from a 
person who was exposed to asbestos while serving the RAN in the 1970s and developed an illness, 
such as mesothelioma, with a clinical onset after 1 July 2004. 
 
The diagrams below illustrate that where an injury or disease has onset after 1 July 2004 and the 
service that relates to that injury or disease was rendered prior 1 July 2004, the VEA or the DRCA 
might apply to that injury or disease, and not the MRCA. 
 
In the first diagram, the person did not serve after 1 July 2004. 
 
In the second diagram below, the person’s service spanned 1 July 2004, but only their pre-1 July 2004 
service can be linked to the injury or disease. 
 
 
The MRCA will apply to neither of these claims and depending on the details of service, either the VEA 
or the DRCA, or both, may apply. 
 
Applying the Transitional Provisions to a single claim for multiple injuries or diseases lodged by a 
person with service that spans 1 July 2004 might result in the MRCA applying to some of those injuries 
and diseases, and not applying to others, depending on the way in which each injury or disease might 
be related to service. For example, a claim made for PTSD and chondromalacia patella of the right 
knee might result in the MRCA not applying to the claim for PTSD because it relates to a stressor 
which occurred on deployment in 2003, but with the MRCA applying to the right knee condition 
because it relates to a trauma suffered in 2006. 
 
It should be noted that for the purposes of the Transitional Provisions, an aggravation of an injury or 
disease is treated as a new injury or disease. There are also important differences in the way that 
aggravations of conditions are treated under legislation, depending on whether the original 
underlying condition can be accepted under the DRCA or the VEA.

It is possible for the DRCA to apply to a claim for the same condition as the MRCA. This will happen in 
circumstances where the onset of original injury disease occurred prior to 1 July 2004, and relates to 
service rendered before that date, but a worsening due to aggravation (as opposed to natural 
deterioration) relates to service rendered on or after 1 July 2004. For example, a person might claim 
PTSD with onset related to a stressor that occurred during peacetime service in 2003. However, the 
symptoms of the PTSD might have worsened after a subsequent stressor during peacetime service in 
2006. In this case, the MRCA will not apply to the claim for the onset of the condition, but the DRCA 
will, whereas the MRCA will apply to a claim for the aggravation that occurred in 2006. 
 
This scenario is illustrated in the diagram below. 
 
The situation is different under the VEA, which will cover both the onset and the aggravation in same 
or similar circumstances. In this case, for example, a person might claim PTSD with onset related to a 
stressor that occurred on deployment in 2003. However, the symptoms of the PTSD might have 
worsened after a subsequent stressor during peacetime service in 2006. In this case, the MRCA will 
not apply to either the claim for the onset of the condition or the aggravation, but the VEA will apply 
to a claim for both the onset in 2003 and the aggravation that occurred in 2006.

Dual Eligibility 
 
While the DRCA and the MRCA are often labelled together as the “contemporary Acts”, there is, in 
fact, more overlap between the VEA and the DRCA in terms of cohort coverage. While the operation 
of the Transitional Provisions outlined above prevents the MRCA applying to a claim for the same 
injury or disease as the VEA or the DRCA (with the exception noted for aggravations above), a claim 
can be made under both the VEA and the DRCA for the same injury or disease. 
 
Where a claim is successful under both Acts, offsetting occurs to ensure that the claimant is not 
compensated twice under both Acts for the same ‘incapacity’. It is important to recognise that the 
operation of the offsetting provisions may influence a person’s choice about under which Act they 
want to make a claim. 
 
The DRCA applies to claims for peacetime service (including part time service with the Reserves, 
cadets, etc.), and peacekeeping service and hazardous service (also referred to as non-warlike 
service). The DRCA also applies to claims for injuries or disease related to operational service 
rendered on or after 7 April 1994. 
 
The VEA applies to claims for operational service (either warlike or non-warlike). The VEA covers 
peacetime continuous fulltime service (CFTS) rendered on or after 7 December 1972 and before 1 July 
2004, where the claimant enlisted before 22 May 1986 and continually served up to 7 April 1994. The 
VEA also covers peacetime CFTS rendered on or after 22 May 1986 and before 7 April 1994, where 
the claimant completed 3 years continuous service before 7 April 1994. 
 
The diagram below demonstrates where peacetime service may give rise to dual eligibility under the 
VEA and the DRCA.

Lodging a claim 
 
Al  three Acts contain provisions that are broadly similar in the way that they prescribe the manner in 
which a claim can be made. General y, a claim should be in writing and in accordance with 
requirements specified by the relevant Commission or prescribed in regulation (if any). The relevant 
provisions governing the way in which a person may make a claim for liability or compensation 
payments under that Act are s5T and s14 of the VEA, s54 of the DRCA and s319 of the MRCA. 
 
Controls over the making of claims are important, as the date a claim is taken to be lodged can 
directly affect the calculation of compensation payments under the VEA or the MRCA (though this is 
not a consideration under the DRCA). 
 
There is no legislative mechanism under the VEA or the DRCA to make only an ‘initial liability’ claim. It 
is a standard process in assessing a claim to determine whether the injury or disease relates to 
service; i.e. to establish liability. However, under the current legislation this is not a separate process 
for a claim for disability pension under the VEA or claim for compensation under the DRCA. 
 
Section 54 of the DRCA does not require an applicant to specify the nature of the compensation 
sought. However, DVA’s claim processing workflow for the DRCA is currently based on a concept that 
under the DRCA initial liability is a threshold and separate step. This mirrors a similar approach taken 
by Comcare in its administration of the Safety, Rehabilitation and Compensation Act 1988, upon 
which the provisions of the DRCA are derived. General y, a single delegate considers the initial liability 
aspects of the claim and then one or more other delegates consider any subsequent compensation 
aspects of the claim. DVA is trial ing some ‘combined benefits processing’ (CBP) teams, which utilise a 
single delegate to determine both the liability and permanent impairment aspect of a claim. 
 
DVA’s claim processing workflow for disability pension claims under the VEA mirrors the legislation. 
Initial liability and assessment of the rate of pension are combined under one-step and handled by a 
single delegate. 
 
Under MRCA, s319 authorises the making of claims for both acceptance of liability and for 
compensation. In theory, this can be done concurrently or sequential y. DVA’s administrative 
processes attempt to ensure that this is done sequential y. This ensures that claims for compensation 
are not lodged prior to the acceptance of liability for a service injury or service disease. General y, a 
claim for compensation cannot be determined favourably until liability for a service injury or service 
disease has been accepted. 
 
General y, the provisions mentioned above under each Act require that a claim for compensation 
shal  be in writing and in accordance with a form approved by the relevant Commission (there are 
exceptions for oral claims for compensation under the MRCA and the DRCA). The VEA expressly sets 
out that a claim shal  be accompanied by such evidence available to the claimant as the claimant 
considers may be relevant to the claim.  The VEA also provides expressly that a claimant may submit 
evidence in support of the claim subsequently to the making, but before the determination, of the 
claim. 
 
A claim lodged with DVA in accordance with the relevant provisions is taken to have been made on 
the day it is received by DVA. A claim approved by the Commissions for electronic lodgement is taken 
to have been lodged if the claim is transmitted electronical y in a manner approved by the

Commissions and to an electronic address approved by the Commissions. The claim is taken to have 
been so lodged on the day on which it is so received at that electronic address. 
 
The fol owing methods of claiming satisfy the requirements set up by Commission for claims made 
under s14 of the VEA, s54 of the DRCA and s319 of the MRCA: 
 
•  Form D2582 (Claim for Disability Pension and/or Application for Increase in Disability Pension) 
•  Form D2020 (Claim for Rehabilitation and Compensation [under the DRCA]) 
•  Form D2051 (Claim for Liability and/or Reassessment of Compensation under MRCA) 
•  Online Single Claim Form via DVA website, MyAccount and ESO Portal; and 
•  MyService. 
 
Paper forms listed above may be lodged through Australia Post, hand delivered to an on base Veteran 
Support Officer or the various State and Territory offices in the Veteran Access Network (VAN), 
emailed as an attachment to an approved email address, or faxed to an approved fax number. 
 
Onus on Commissions to Investigate a Claim 
 
Once a valid claim has been lodged as prescribed, each Act creates a statutory obligation for the claim 
to be investigated and determined, as per s19 of the VEA or s333 of the MRCA. The DRCA does not 
include a specific statutory obligation, but one can be implied by the Act as a whole and the functions 
of the Commission under s142. Therefore, once a claim is made, it must be determined and cannot be 
withdrawn by the Department without the consent of the claimant. 
 
Registration, Screening and Al ocation 
 
Registration represents the point at which claims made, and assorted documents received, are 
registered in the DVA processing system, known as ISH. When a claim is registered it wil  general y be 
registered under one Act for investigation (though there are exceptions discussed below) and 
al ocation wil  occur in line with this registration. The claim wil  go into the queue of claims awaiting 
al ocation. 
 
After registration and prior to al ocation to a delegate, the claim wil  be screened. This usual y 
happens within a day or two of the claim being registered. Current al ocation protocols are for claims 
to be processed in date order.  That is, claims once registered are held in various queue arrangements 
and the oldest claims al ocated to the next delegate with capacity to investigate and determine. 
 
Claimant’s experiencing certain circumstances or conditions may be considered as priority or ‘at-risk’ 
clients. While the claim form may not present al  the client’s risk factors, the screening team wil  also 
review other submitted documentation, along with any relevant historical information held on the 
claimant’s file.  This may include service records, medical documentation and statements the claimant 
has made.  If additional support is deemed necessary, a referral is made to Client Support Framework 
such as Triage & Connect, Coordinated Client Support, Open Arms and other escalation services. At-
risk clients have their initial liability claims referred immediately to a delegate after being screened, 
thus bypassing the queue.

It is estimated that around 30 per cent of claims lodged are identified for priority action, either 
initial y by the screening team or at a later point in time once DVA is notified about further details of 
the claimant’s circumstances. It should be noted that a balance needs to be maintained in the number 
of claims that are identified for priority action. If too many claims are prioritised, this wil  negatively 
affect other claimants, as their claims wil  wait in the queue longer before they are al ocated. 
 
Paper claim form 
 
Al  three paper claim forms provide a cross-Act authority that enables delegates to undertake 
investigations and make determinations under al  three Acts, without seeking further approval to do 
so from the claimant. Previous versions of the claim form required the delegate to contact the 
claimant, or representative, and request a new completed claim form under the correct Act or a 
completed Release Authority Form. 
 
Delegates must identify which version of a claim form has been used to determine whether there is a 
need to obtain a completed release authority from the claimant, or representative, or whether the 
latest version of the form has been used and so sufficient consent has been provided. 
 
Despite this cross-Act authority, where a claim is made on a paper claim form, the form itself dictates 
which Act the claim is registered under; i.e. a claim on the D2582 is registered as a VEA claim, a claim 
on a D2020 is registered as DRCA claim, and a claim on a D2051 is registered as MRCA claim. Once the 
claim is ready for al ocation, it wil  be al ocated in accordance with the Act it has been registered 
under. 
 
After al ocation, where a delegate finds an apparent error in the Act under which the claim as been 
registered, the delegate wil  contact the claimant or the representative, usual y by phone, and discuss 
the error with him or her. This might result in, with the claimant’s consent, the claim being withdrawn 
under the Act it was original y registered under and an investigation commencing under a new Act. 
Alternatively, it may result in the original claim being progressed at the claimant’s request, even 
where it wil  ultimately be denied. 
 
For example, where a claim is made using a D2020, the claim wil  be registered under the DRCA. The 
claim wil  be al ocated to a DRCA delegate, most likely based in the Melbourne office. During the 
investigation of the claim, the delegate may become aware the claim cannot be accepted under the 
DRCA; for example, where the claimant has only rendered service on or after 1 July 2004. In this 
scenario, the delegate wil  contact the claimant, or representative, and seek his or her agreement to 
progress the investigation to a determination under the MRCA. If the claimant disagrees, the 
investigation and determination wil  continue under the DRCA (and in this scenario, would have to be 
a rejection due to the operation of the Transitional Provisions). 
 
Regardless of the outcome of the phone conversation in these circumstances, it is likely the delegate 
who was original y al ocated the claim wil  continue to investigate and determine under the relevant 
Act, unless there is a reason this is not possible (e.g. delegate lacks skil s and training in that area). 
 
Where a paper claim is lodged on either a D2582 or a D2020, the claim is registered under the VEA or 
the DRCA. The claimant is these circumstances might have dual eligibility for the claimed injury or 
disease under both Acts. The progress of the claim wil  depend on whether this is the claimant’s first 
claim under DVA administered legislation (e.g. a ‘cleanskin claim’) or whether they have previously 
made a claim or claims. Where the claim is a cleanskin claim, it wil  be investigated and determined in 
accordance with the Act corresponding to the form used to make the claim. Where the claimant is in

receipt, or has received compensation previously, the delegate wil  often be guided by this when 
progressing the new claim. 
 
For example, if the claimant is in receipt of disability pension under the VEA, and lodged a new claim 
or application for increase using a D2582, this wil  be progressed under the VEA as per the initial 
registration. It is unlikely that the delegate wil  take any further action to consider potential dual 
eligibility under the DRCA. However, if the new claim is lodged on the D2020, it is likely that the 
delegate, after identifying that the claimant is in receipt of disability pension under the VEA, wil  make 
contact with the claimant, or representative, to discuss which Act the new claim should be 
investigated and determined under. 
 
Online Single Claim 
 
Claimants using the Online Single Claim (OSC) form via the DVA website, ESO Portal 
and MyAccount are asked if they wish to opt out of having their claim considered under specific Acts. 
Claims are, then registered under the Act or Acts which have not been the subject of an explicit opt-
out and are al ocated on this basis. 
 
Furthermore, the OSC requires the fol owing mandatory question to be answered “yes” or “no” by the 
claimant or representative: 
 
“It may become evident to DVA during the investigation of this claim that you may 
have entitlement under one or more Acts (VEA, DRCA or MRCA) instead of, or in 
addition to, the Act/s identified above. If this occurs, do you wish for DVA to 
consider that entitlement?” 
 
“Yes” provides the delegate with the authority to investigate and determine the claim under other 
Acts that the claimant has not explicitly opted out of. The delegate should consider the applicability of 
other Acts if, after considering supporting evidence, the delegate forms the judgement that other 
Acts might apply, excluding Acts the claimant has opted out of. The delegate should contact the 
claimant and discuss processing options including the withdrawal of a claim or claims where there is 
no applicability under the nominated Act. If the claimant does not wish to withdraw claim or claims, 
the delegate must determine the claim under the Act or Acts identified in the lodged OSC. 
 
“No” removes the ability for a delegate to investigate and determine the claim under any other Acts. 
The claim wil  not be considered under any other Act. The delegate wil  proceed on the basis that the 
claimant has only lodged a claim under the Acts included in the OSC and the delegate wil  not 
investigate or determine under any other Acts. The delegate must determine the claim under the Act 
or Acts identified in the lodged OSC. 
 
MyService 
 
MyService runs a simple ruleset over a claim lodged and recommends an Act for the claim to be 
investigated and determined under. For “seven computer-based” conditions, MyService notifies the 
claimant that the claim has been accepted under the MRCA where certain rules are met. However, 
the claim must stil  be processed through ISH. 
 
MyService does not provide the claimant with an opportunity to direct DVA about which Act a claim is 
being made under. It operates on the principle that DVA should choose the most appropriate Act for 
the claimant to lodge his or her claim under. Below is an extract from the MyService terms of use. It 
was prepared on the understanding that MyService claims are not Act specific.

The authority to obtain information relevant to your claim is contained in the 
provisions of the Military Rehabilitation and Compensation Act 2004 
(MRCA), Veterans’ Entitlements Act 1986 (VEA) and the Safety, Rehabilitation and 
Compensation (Defence–related Claims) Act 1988 (DRCA). By registering for 
MyService you consent to the department considering your claim under one or more 
of the above Acts. You understand that the information sought on the claim form is 
required to assess your eligibility for compensation under al  Acts (VEA, DRCA and 
MRCA) that may be applicable to the injury or disease which you are now claiming. 
 
MyService wil  make a recommendation based on the date of clinical onset input by the claimant, 
taking account of the service dates entered by the claimant. For example, if the claimant enters a 
clinical onset date on or after 1 July 2004, and indicates that they have discharged after 1 July 2004, 
MyService wil  recommend that the claim be investigated and determined under the MRCA. The claim 
is then registered and al ocated in accordance with this recommendation. 
 
It is not uncommon for this recommendation to be incorrect. For example, a late-onset condition 
might have clinical onset on or after 1 July 2004, but relate to service rendered solely before that date 
(even though the claim has served on or after that date). In these circumstances, the 
recommendation made by MyService wil  be incorrect under law, and it wil  be up to the delegate to 
identify this error. 
 
It is also not uncommon for a claimant to enter an incorrect date for clinical onset. Many of the 
legislative instruments known as Statements of Principles (SOPs) that govern the determination of 
issues of causation under the VEA and the MRCA (but not the DRCA), require that clinical onset (or 
clinical worsening in the case of aggravations) occurs within a certain timeframe relevant to the 
incident, activity or exposure that potential y caused the injury or disease that is being claimed. For 
example, a causal factor in the SOP for posttraumatic stress disorder, which is used to link that 
condition to warlike or non-warlike service, requires: 
 
“living or working in a hostile or life-threatening environment for a period of at least four 
weeks before the clinical onset of posttraumatic stress disorder….” 
 
If the wrong clinical onset date is entered in MyService, this could put the clinical onset inside or 
outside the four week period required in the factor above. This wil  lead to an incorrect application of 
the SOP factor and the claim potential y being accepted incorrectly, or is some cases rejected if the 
delegate does not correct the error during his or her investigation and no other SOP factor can be 
satisfied. 
 
In certain circumstances, MyService wil  recommend an investigation of the claim under both the VEA 
and the DRCA. However, it is common practice for the registration team to register the claim under 
only one Act. Where the claim is a ‘cleanskin claim’, as discussed above, the claim wil  often be

Summary of discussion points from papers provided by members after 
meeting held on 3/3/21 
At the first meeting of the ESORT Multi Act Claims Working Group held on 3/3/2021, members 
agreed to prepare “one page” submissions regarding multi act claims. A summary of items submitted 
by members for future discussion is listed below. More detailed information covering each item in 
the list is contained in the documents circulated by members out of session. For the purposes of the 
meeting on 7/7/21 these documents are taken as read. 
Items for consideration for discussion as submitted by members are- 
•  Recommendation not to combine VEA & DRCA 
•  Streamlined acceptance of defined conditions available under VEA & MRCA to apply to DRCA 
•  Medical Diagnosis/Opinion CMA/CMO and MLOCA. When a treating GP or a treating 
specialist diagnoses a veterans’ condition that condition should not be changed by a DMA. 
•  Expand Non-Liability Health Care to muscular-skeletal conditions 
•  Fairness of offsetting methodology 
•  On-line claims lodgement and application of the correct Act including permission to consider 
the claim under a different Act to the one specified 
•  ESO Portal be updated to auto populate key details of the same veteran for different claims 
•  Providing feedback to delegates where decisions have been overturned at the VRB and AAT  
•  Advocate access to “Clik” 
•  Recognising and preserving the difference between peacetime and warlike/non warlike 
service including preserving the “balance of probabilities” and “reasonable hypothesis“ 
standards of proof for their respective service types. Another member recommended that 
the “reasonable hypothesis“ standard be applied in al  cases. 
•  DVA introduce a “what is new” service to ESOs, advocates and the general public. 
•  SOPs should not be abolished 
•  Do not introduce SOPs to DRCA. 
•  The Lifestyle Questionnaire should only be sent to a client after liability has been accepted. 
•  When a delegate accepts liability they should then determine compensation. There is no 
benefit in transferring that file after liability has been accepted, to another silo. 
•  When a delegate receives a veterans’ claim, which has no input from an advocate and is 
clearly destined to fail, it should be returned to the veteran with a covering letter. The letter 
should advise that it is not likely to be approved, give a list of ESOs that provide advocacy 
services (in the appropriate State or Territory) and recommend that the veteran contact the 
ESO of choice for advice. 
•  A warning could be placed in My Service along the lines of “CAUTION:  It is strongly 
recommended that you consult an accredited advocate before submitting your claim.  You 
can find your nearest advocate at advocateregister.org.au” 

 
 
•  Recommend that the requirement for a condition to be  “permanent and stable” before 
compensation can be paid be removed from DRCA and MRCA 
•  Lack of alignment between current medical impairment assessment forms and the 
Impairment guides
