Dear John Smith,
I refer to your application made under the Government Information (Public Access) Act 2009 (the GIPA
Act) to the Greater Sydney Commission (Commission) dated 31 January 2023 requesting access to:
“I request the Declaration of Interests forms submitted by the Chief Commissioner
and each of the City Commissioners. Declaration of real estate holdings including
primary residences are of special interest. The most recent declaration form for
each person please.”
The Commission has processed your application based on information held by the Greater Cities
Commission as at the date of receipt of your application.
I have today decided your application, under section(s) 58(1)(a) of the GIPA Act, by providing access
to the record(s) described in Annexure A.
Public Interest Considerations Against Disclosure
There is a presumption in favour of disclosing government information. You have a legally
enforceable right to be provided with access to the information sought, unless there is an overriding
public interest against disclosure of the information.
Section 14 of the GIPA Act provides a table of public interest considerations against disclosure to
be taken into account. Items listed in the table that may be considered include where disclosure
could reasonably be expected to reveal an individual’s personal information or contravene an
information protection principle under the
Privacy and Personal Information Protection Act 1998.
Public Interest Test
In relation to the records described in Annexure A, I have applied the public interest test by weighing
the release of personal information against the public interest consideration under s 12(2)(e) of the
GIPA Act and have decided that there is an overriding public interest against disclosure that applies
to personal information including:
• Signatures
• Addresses
• Full names

Accordingly, access to that information is refused and copies of the redacted records are enclosed.
Disclosure Log
The Commission is required to keep a disclosure log which records details of access applications that
the Commission has decided by providing access to the information requested where the Commission
considers the information to be of interest to other members of the public.
I have decided that the information that is to be released to you will also be disclosed on the
Commission’s disclosure log.
Fees and charges
The GIPA Act entitles the Commission to charge for the processing of an application, even in
circumstances where a decision is made that the Commission does not hold any information falling
within the scope of the application.
Although approximately eight hours have been spent by the Commission processing your
application, I have decided that no further charges should be imposed for this application.
Rights of review
These decisions are reviewable decisions under s 80 of the GIPA Act. If you are aggrieved by my
decisions, you may seek review under Part 5 of the GIPA Act.
There are three forms of review:
• internal review by a senior officer of the Commission,
• external review by the Information Commissioner, or
• external review by the Administrative Decisions Tribunal.
Your review rights are summarised in the enclosed fact sheet. You have 20 working days after the
date of this letter to apply for an internal review, and 40 working days to apply for an external review.
