Freedom of information request
I refer to your correspondence dated 28 March 2023 in which you requested:
Please provide details of parking fines issued in “No Stopping Area” pursuant to
Road Safety Rules 2017 - Road Rule 167, on Boathouse Drive between 26/03/2022
and 26/03/2023.
You are making a request under the
Freedom of Information Act 1982 (Vic) (
FOI Act),
however at this time your request is not valid under section 17 of the FOI Act because you
have not paid the application fee of $30.60 and it is not clear and specific enough for us to
identify the documents you have requested.
This means we cannot start processing your request until you pay the application fee or
request a fee waiver
and give us more information about your request.
Paying the application fee
To proceed with your request, please pay the application fee of $30.60 by bank cheque,
money order, credit card or cash to:

Requesting a fee waiver or reduction
If paying the application fee would cause you hardship, you may ask us to waive or reduce it.
To do this, please provide supporting information so we can assess your eligibility for a fee
waiver or reduction.
Supporting information may include a copy of a current concession or health care card, a
bank statement, or statutory declaration outlining why paying the application fee would

cause you hardship. If you are not sure what information to provide, please contact us to
discuss further.
Your request requires clarification
For your request to be valid under section 17 of the FOI Act, it must provide enough
information about the documents you asked for so we can properly identify them.
If the terms of a request are not sufficiently clear, it wil not comply with section 17 of the FOI
Act and we cannot process it.
At this time, your request is not sufficiently clear. Accordingly, enquiries were made with
Parking Services regarding your request. These enquiries identified that there are 23 no
stopping signs (the red crosses) and areas (colour coded) in the named street covering both:
-no stopping area vehicle engaged in taking up or setting down of goods excepted and,
-no stopping area of valid parks and recreation parking permits in marked bay only
excepted. Please see the below map.
To help determine whether your request is suf iciently clear to enable searches to be
undertaken for the relevant documents, please answer the following questions:
1. Please Identify the no parking signs (identified by the red crosses) or the colour
coded no parking areas you are referring to.
2. Please clarify what ‘details’ are being sought regarding the parking fines
issued along this named street. Note that personal affairs information is
exempt from release under the FOI Act where its disclosure would be
unreasonable. The documents which you seek are likely to contain ‘personal
affairsinformation’ of people other than yourself. Personal affairs information
includes any information from which any person’s identity, address or
location can be reasonably determined (such as names, job titles, direct
contact details etc.).
Prior to determining whether or not the personal information should be
released, s33 of the Act requires Council to contact each individual whose
information it contained in the documents, to notify them of the request
and seek their views on whether or not their personal affairs information
should be disclosed. If individuals do not consent to the release of their
personal affairs information, and the Council subsequently decides that it
would be suitable for release, then their personal affairs information
cannot be provided to you until the expiry of a mandatory 60 day appeal
period.

If we do not hear from you by 8 May 2023, we may close your request without processing it.
If we close your request without processing it, you wil need to make a new request if you
