Decision on freedom of information request
I refer to your email dated 3 July 2025
in which you request access, under the
Freedom of Information Act 1982 (Cth) (the Act), to:
‘1. SES Performance Agreement Template(s) for 2023–24 and 2024–25
All template(s) or model SES Performance Agreements used by the ACCC to set
performance objectives and assess performance for Senior Executive Service (SES)
officers in the 2023–24 and 2024–25 performance cycles.
2. SES Variable Remuneration / Bonus Scheme Documentation
All policy or guidance documents, communications or frameworks that describe the
ACCC’s SES variable remuneration (bonus) scheme for 2023–24 and 2024–25, including
details on:
* Which Common Performance Indicators (CPIs) or KPIs are linked to variable pay;
* The weighting or percentage of total remuneration at risk for each indicator;
* The process by which SES officers’ achievement against those indicators is assessed
and bonuses determined.’
Scope of request and identified documents
We have identified 3 documents as falling within the scope of part 1 your request.
Please note that no documents were identified as within the scope of part 2 of your
request, as the ACCC does not pay bonus’ to SES officers and has not done so
since 2011.
Decision
I have decided to
release these documents to you in full in accordance with the
Schedule (Attachment A). Your review rights are set out in Attachment B.
I am authorised under s.23 of the Act to make this decision.
Charges
Under the Act the first 5 hours ($100.00) of processing your request are free. As the
cost of processing your request is less than $100.00, there are no charges for
processing your request.
Enclosed are copies of the 3 documents which were 'Granted', as per the Schedule.
Disclosure log
In accordance with s.11C of the Act, I have decided to publish the documents
released on the ACCC’s Disclosure Log. This will occur within ten business days of
the documents being released to you.

ACCC Internal Review
