Under the Freedom of Information Act 1982, I hereby request access to the following documents held by the Australian Competition and Consumer Commission (ACCC):
1. SES Performance Agreement Template(s) for 2023–24 and 2024–25
All template(s) or model SES Performance Agreements used by the ACCC to set performance objectives and assess performance for Senior Executive Service (SES) officers in the 2023–24 and 2024–25 performance cycles.
2. SES Variable Remuneration / Bonus Scheme Documentation
All policy or guidance documents, communications or frameworks that describe the ACCC’s SES variable remuneration (bonus) scheme for 2023–24 and 2024–25, including details on:
* Which Common Performance Indicators (CPIs) or KPIs are linked to variable pay;
* The weighting or percentage of total remuneration at risk for each indicator;
* The process by which SES officers’ achievement against those indicators is assessed and bonuses determined.
Processing and Disclosure
Please process this request under the standard provisions of the FOI Act. If any part of this request is deemed exempt or conditionally exempt, please release any otherwise disclosable portions of the documents and annotate the reasons for nondisclosure in accordance with FOI guidelines.

Fee Waiver
If there is any fee associated with processing this request, I request a waiver under section 24AA of the FOI Act on the basis that disclosure of these documents serves the public interest in transparency around the remuneration and incentive structures that influence SES performance.

The Australian Competition and Consumer Commission (ACCC) acknowledges
receipt of your web submission of 3 July 2025 requesting access, under the
Freedom of Information Act 1982 (Cth), to:

Timeframe for processing your request
The ACCC has 30 days to process your request, beginning 3 July 2025. This
timeframe may be extended by a further 30 days by the ACCC where
consultation with certain third parties is necessary. You will be advised
if we extend the timeframe for third party consultation.
Charges
I note you have requested that the charges associated with processing your
FOI request be waived on public interest grounds.
The ACCC has yet to decide whether charges will be imposed for processing
your request. Should any such charges be imposed you will be notified in
due course and you will have the opportunity to request that such charges
be waived or reduced.
Practical refusal
If we are unable to identify the documents you are seeking, or processing
your request would substantially and unreasonably divert the ACCC’s
resources from its other operations, we will send you a notice of our
intention to refuse your request and your options, including if you
disagree.
Decision
A decision maker will assess the documents (if any) to decide if we can
release them, or if they are exempt from release. We will send you the
decision and notify you of your review rights.
We will only release documents once any applicable processing charge is
paid.
If we cannot locate any documents that are covered by the scope of your
request, or if we refuse to confirm or deny the existence of documents, we
will advise you of this and your review rights.
Publication of documents released under FOI
Material released under FOI may be published on our website unless we
consider it unreasonable to do so.
