Freedom of Information – Notice of Decision
I refer to your application under section 30 of t
he Freedom of Information Act 2016
(the FOI Act), received by the City and Environment Directorate (CED) on 18 December
2026. Your application was received by partial transfer from the Chief Minister, Treasury and
Economic Development Directorate (CMTEDD). This decision relates solely to information
held by CED. It is my understanding you initially sought access to the following information:
• “...a
list of ACT government assets that have been sold over the last 20 years,
including the date of sale and the price. Sales by the Suburban Land Agency are
excluded from the scope of this request”.
I thank you for engaging with our office on 23 January 2026 to clarify the scope of your
application, in which you amended the scope of your application as follows:
•
“I am only seeking information related to assets that were sold off as part of the
budget process, for example, ACTTAB, public housing, commercial properties etc”.
Timeframes
In accordance with section 40 of the FOI Act, CED is required to provide a decision on your
access application within 30 working days. Therefore, a decision is due on or by
10 February 2026.
Authority
I am an Information Officer appointed by the Director-General of the City and Environment
Directorate under section 18 of the FOI Act to deal with access applications made under Part
5 of the FOI Act.
Decision on access
A search for CED records has been completed and no information within the scope of your
application have been identified. This search included the review of asset registered and was
found to only include information relating to assets outside of the scope of your application. I
am confident that all reasonable steps to identify relevant information have been exhausted
and decide under section 35(1)(b) of the FOI Act that the type of information you seek is not
held by CED.

Charges
Processing charges are not applicable for this application as no records are being released
to you.
