Request for Waiver or Reduction of the Application Fee under s 17 (2b) of the Act
Requesting a Waiver
Under s 17 (2b) of the
Freedom of Information Act 1982 (“Act”) the application fee may be waived or
reduced, if payment of the fee would cause hardship to the applicant. Please note,
if accepted, this
waiver
only covers the application fee
and
not the access charges that may be payable under the
Freedom of Information (Access Charges) Regulations 2014 (“Regulations”).
Hardship arises when,
payment of the application fee would cause severe suffering or privation (lack of
the comforts or necessities of life). Definition from www.foi.vic.gov.au.
Information required by Council
If you wish to apply to have the application fee waived or reduced, apply to Council, in writing, stating why
you feel payment of the fee would cause you hardship and include a copy of any supporting evidence you
wish to provide. Examples of evidence are, but not limited to:
• Concession card issued by Centrelink (Pension, Veteran Affairs)
• Evidence of unemployment.
