FOIREQ22.00211 Consultation Bundle Redacted.pdf
Dear Baroness Beeban Kidron,

FOIREQ22/00211
Freedom of information request and opportunity to make submission
I am writing to inform you that the Office of the Australian Information Commissioner (OAIC) has
received a freedom of information (FOI) request, the scope of which includes documents
containing your personal information.
The relevant documents are attached.
Under the Freedom of Information Act 1982 (FOI Act), when we receive a request covering
documents of this kind and we believe the person or organisation concerned may wish to
contend that the documents are exempt from release, we are required to consult before
releasing the documents, if it is reasonably practicable to do so (under s 27A of the FOI Act).
Opportunity to make a submission
I invite you to make submissions raising any objections you may have to the release of the
attached document under the following exemption in the FOI Act (paraphrased):
1.  Section 47F – disclosure would involve the unreasonable disclosure of personal
information of any person (including a deceased person). This exemption is intended to
protect the personal privacy of individuals.
We note that more information about s 47F is available in the Part 6 (Conditional exemptions) of
the FOI Guidelines, available at www.oaic.gov.au/freedom-of-information/foi-guidelines/part-6-
conditional-exemptions.
Access must be given to documents covered by a conditional exemption under s 47F unless this
would be contrary to the public interest. If you consider that the document falls within the scope
of s 47F you must also indicate whether you believe that disclosure would be contrary to the
public interest.
If it is your view that any of the documents falls within the scope of the exemptions outlined
above, would you please consider whether deletion of any specific information from the relevant
document (under section 22) would address your objections.
Please note that it is not sufficient simply to assert that one of the exemptions applies and that
disclosure would be contrary to the public interest. You need to provide reasons and supporting
evidence. Also, while your comments will be taken into account, the final decision about
whether to release the documents rests with the decision maker in our agency. If the decision

FOIREQ22/00374   002
maker decides to grant access to any document whose release you opposed and you have made
a submission in support of your contention that the document is exempt under one of the
provisions of the FOI Act above, you will be given written notice of the decision and the
opportunity to seek review of the decision before the document is released.
Please note that we have only sent you the documents we wish to consult with you on.
Other matters you may wish to note
Beyond the above outlined exemptions, it would be much appreciated if you could note if there
are any other sensitivities you wish to note regarding the release of this document.  Particularly
if you consider our consultation with you regarding this issue is in itself sensitive.
Disclosure log
If we decide to grant access to the requested document we are generally obliged to publish the
information on our disclosure log.
How to make your submission
Please send your comments in writing by close of business on Monday 19 September 2022 by
return email to me. Please cc in xxxxx@xxxx.xxx.xx and use OAIC reference FOIREQ22/00211 in
all correspondence. We note and apologise for this short timeframe. We are requesting your
response in this time to allow us to meet the statutory timeframe under the FOI Act.
If a response is not received by this date, I will assume you do not object to the release of the
document.
Please note that information outside of the scope of the applicant’s FOI request has been
redacted from the attached bundle.
If you have any questions, please feel free to contact me.
Kind regards,

Llewellyn

Hi L See my comment within. Please amend and send. Kind regards Marg 10/08/2022 Hi Marg, After
speaking with Emma, I have drafted acknowledgement to the FOIA, requesting that they clarify the scope
of their request. Would be appreciated if you could clear. Once scope is confirmed, Emma has suggested
we advise the commissioners x 2 (Angelene/ Leo with cc to Libby) about the request separately. Kind

Prepare ack to FOIA 3. Draft S&R to Executive Assistant and CC Angelene, Libby - need to check with
Emma about recipients for this. Check Sam Lidbetter's email about things we need and whether she

Hi L I had a quick look at the material from line area. We may need to undertake CC/TPC with a number
of agencies and private individuals/organisations given its contents, if we are considering release. Can
you please review the material, get a paralegal to create a bundle and schedule for you, so we can

Hi Emily I have now updated the draft CC emails with addresses for recipients and updated the due date
(based on us sending off today). Please let me know if they can be sent off - the ACCC has also

changes. Thanks Mol y 6/09/2022 Hi Mol y, ACCC bundle and draft email look good please finalise and
send. Same for email to Sam. I made a few final changes to email to John. I have decided we won't send
a copy of the doc its a lot of work and doesn't real y add anything - if anyone asks we can provide. Yes
please draft al  in single word doc and I wil  review. Thanks. Hi Emily Please see the fol owing updated
docs for your review: 1. ACCC Bundle - I have now saved a redacted version. I did one more search of
the main bundle and identified two more pages where the ACCC is mentioned but where it wasn't
highlighted in green. These don't appear to be in relation to the secondment so there may not be an
issue with them but I have included these in the redacted bundle anyway for you to check as it is easier
to just look at them along with the other pages and I can delete later if these are irrelevant. These are
the last two pages in the Redacted ACCC Bundle. 2. Draft email to Samantha Lidbetter asking for contact
details. 3. Draft PM&C email - I have accepted your changes and updated to only be addressed to John
per your comments below. Once approved I wil  use this as a template to draft emails to al  other parties
(and once we have contact details). As there are quite a few people I am mindful of clogging up the file -
do you want me to put al  draft emails in one word doc for you to review? Thanks Mol y 2/09/2022 Mol y,
Thanks for helping with this matter. For the ACCC bundle - see comments in table - with the documents
we need to redact everything that isn't relevant to ACCC consult for the documents and then remove
green highlighting. The draft email looks good. I wil  review docs again and then we can send. We have
extra 30 days now so they can have a week from Monday - 12 Sept to get back to us For other CC - we
wil  need to do individual emails (not grouped by agency). I have left some notes about those we don't
need to consult with. Can you review. Please prepare draft email with al  names that we don't have email
address for to Sam Lindbetter asking her to assist and provide contact email addresses for my review.
Please see mark up's on draft PM&C email. We can then prepare the individual emails. Same time frame
12 Sept Happy to discuss. Emily Hi Emily Please see the fol owing docs on the file for your review: 1.
Schedule of al  parties highlighted in green - I have put some comments in this table pointing out some
areas I'm not sure about 2. Bundle of al  pages where the ACCC is highlighted in green 3. Draft CC emails
to the ACCC and PM&C. The ACCC is more like a standard CC but I have drafted the PM&C to be a bit
more informal to then use as a base for the remaining parties. I have just read the previous filenotes
after drafting these and I can see that we have received a TPC extension so I wil  update the deadlines in

Incoming cal  from Sonia Petrovski of ACCC regarding our CC email. She advised they would not be able

need a response until next Monday 12 Sep per our email - she had misread the due date. They wil  have
