Under Freedom of Information I request any available documents detailing the agreements between the Australian Federal Police and the Indonesian National Police. This may include Memorandum of Understandings, agreements and communications between the two agencies.

Please limit this request to documents between 2000 and 2007.

Please further limit the request to only agreements concerning people smuggling, refugees, asylum seekers and irregular or illegal migrants.

Dear Asher

 

I refer to your applications dated 19 April 2018, in which you seek access
to documents under the Freedom of Information Act 1982 (the Act) in the
following terms:

 

“Under Freedom of Information I request any available documents detailing
the agreements between the Australian Federal Police and the Indonesian
National Police. This may include Memorandum of Understandings, agreements
and communications between the two agencies.

 

Please limit this request to documents between 2000 and 2007.

 

Please further limit the request to only agreements concerning people
smuggling, refugees, asylum seekers and irregular or illegal migrants.

 

Under Freedom of Information I request any available documents detailing
the agreements between the Australian Federal Police and the Indonesian
National Police. This may include Memorandum of Understandings, agreements
and communications between the two agencies.

 

Please limit this request to documents between 2008 and 2018.

 

Please further limit the request to only agreements concerning people
smuggling, refugees, asylum seekers and irregular or illegal migrants.”

 

The Commissioner of the Australian Federal Police, being the Principal
Officer has authorised me under Section 23 of the Act to make decisions on
behalf of the AFP in respect of the Act.

 

Pursuant to Section 24(2) of the Act, I have decided that your
applications will be treated as a single application, as your two
applications relate to documents, the subject matter of which is
substantially the same apart from the date range.

 

Your request was received by this agency on 19 April 2018 and the 30 day
statutory period for processing your request commenced from that date. 
The due date for a response is 19 May 2018.

 

You will be notified of any charges in accordance with the Freedom of
Information (Fees and Charges) Regulations, should they apply, in relation
to your request as soon as practicable. 

 

Information Publication Scheme

 

Please be advised that in accordance with section 8(2) of the Act, an
agency is required to publish information on their website following the
notification of a decision in respect of a freedom of information
request. 

 

The requirement to publish information released under FOI reinforces the
objectives of the FOI Act to promote a pro-disclosure culture across
government and to increase recognition that information held by government
is a national resource. 

 

Exceptions to the requirement to publish information would apply to
personal information and information concerning the business affairs of a
person if it was considered ‘unreasonable’ to do so.
