Acknowledgement of Freedom of Information Access request

This email refers to an access request received under the Freedom of Information Act 1982 (the FOI Act) on 3 May 2016 seeking access to:
'all emails/memos/newsletters sent to all staff in the agency in the last month.'

Your request has been allocated FOI request number FA 16/05/00333. Please include your FOI request number in all correspondence with the Freedom of Information Section.

Processing times
The statutory time allowed under the FOI Act for processing requests is 30 days. Requests are generally processed in the order in which they are received.

Request for an extension of time
Please be aware that the Department has seen a significant increase in the number of FOI requests received. As a result there are expected delays involved with the processing of FOI requests at the present time. Generally, requests will be processed in the order that they are received. The Department will endeavour to finalise your request as quickly as possible. For this reason the Department seeks your agreement under s.15AA of the FOI Act to extend the timeframe for the processing of your request by 30 days. It would assist the Department in managing its FOI caseload if you could provide a response to this request by close of business, Friday 19 February 2016.

Exclusion of non-SES staff personal details and SES telephone contact details
The Department’s policy is to exclude the personal details of officers not in the Senior Executive Service (SES), as well as the mobile and work telephone numbers of SES staff, contained in documents that fall within scope of an FOI request. If you require names and contact details of non-SES officers, or direct telephone numbers of SES staff, please inform us so the decision maker may consider your request. Otherwise we will take it that you agree to that information being excluded from the scope of your request.

Publication of document
Where documents are released to you in response to your request, the Department may be required to publish these documents on its website within 10 working days in accordance with section 11C of the FOI Act. Publication will not be required where the documents contain personal or business affairs information.

Good morning Mr Wolverton

I refer to your request below, and would be grateful if you could please clarify the scope in order that the Department may commence the task of identifying the documents that fall within the scope of your request.

One interpretation of the scope of your request is that you are seeking access to all emails sent to all staff within the Department. This would constitute an unreasonably large number of documents.

One alternative interpretation of the scope is that you are seeking access to all emails sent to "All Staff", being a specific mailing address within the Department's email system.

Could you please clarify so that the Department may identify which documents fall within the scope of your request?

In addition, in the event that your request is for emails sent to the specific email address "All Staff", a number of these emails may contain links to further information - can you please advise whether you require that additional information to also be retrieved, noting that this will increase the size and complexity of your request. As an alternative to this, you may in the first instance, wish to limit your request to the emails only, and once a decision has been finalised on the release of those emails, consider whether you wish to submit a subsequent request for additional documents, based on the information that may be released to you.

It would assist the Department with the processing of your request if you could provide a response to these queries by no later than Monday 9 May 2016.

Thankyou for your helpful reply.

I wish to clarify that I don't mean every email sent to anyone in the agency. Some organisations have a practice of sending emails to everybody. So I think the option of getting all emails sent to the 'All Staff' address would best suit me.

I don't wish to include all documents linked to the emails. I just request the emails themselves.

Thank you for your email below.
 
We wish to advise that our business area have identified a number of
documents which appear to be relevant to the scope of your request. 
 
At the present time, we are reviewing the document content and will be in
a position to advise you of any charges applicable in the processing of
your FOI request within the next seven days. 
 
However, I note that we wrote to you via email on 5 May 2016,
acknowledging receipt of your request, and also seeking your agreement to
an extension of time.  However, upon checking our emails we do not appear
to have received your response regarding the extension of time.
 
As the Department has seen a significant increase in the number of FOI
requests received, there are delays involved with the processing of FOI
requests at the present time. Generally, requests will be processed in the
order that they are received and the Department is endeavouring to
finalise your request as quickly as possible.
 
For this reason the Department seeks your agreement under section 15AA of
the FOI Act, to extend the timeframe for the processing of your request by
30 days.   If you agree to providing an extension of processing time of 14
days, could you please advise by COB Tuesday 31 May 2016.

This email is to advise you of my decision that you are liable to pay a
charge in respect of the processing of your FOI request in accordance with
section 29 of the FOI Act. Please see the attached notice for further
information.  

 

The current due date for your FOI request is 2 June 2016. In accordance
with section 31 of the FOI Act the legislated processing time for your

I am writing to you about the charges notice that I sent to you on 1 June
2016.  The notice period under the FOI Act expired at close of business on
1 July 2016.  As you did not respond to me by the end of the notice
period, your request is now deemed to have been withdrawn by the operation
of the FOI Act (s.29(2)).  As such your request has now been closed.
