Dear Ms Gibbs,

Transfer of freedom of information request to another agency.

 

I refer to your request under the Freedom of Information Act 1982 (FOI
Act) for access to documents relating to the amount of medical marijuana
grown for medical trials. Specifically, you sought access to:

“the amount of medical marijuana being grown in Australia for use in
medical trials from January 2015 to present”

 

I am writing to tell you that I have transferred the entirety of your
request to the Department of Health. Under section 16(1) of the FOI Act, I
am able to transfer a request if the requested document is not in my
possession but in the possession of another agency or if the subject
matter of the document is more closely connected with the functions of
another agency.

Accordingly, on 4 March 2016 I transferred your request to the Department
of Health, whose functions are more closely connected to the subject
area. 

We received your request on 28 February 2016 and the 30 day statutory
period for processing your request commenced from the day after that
date.  The Department of Health will treat your request as though it
received it the same day that we did.  You should therefore expect a
decision from the Department of Health by Wednesday 30 March 2016.  The
period of 30 days may be extended if the Department of Health needs to
consult third parties or for other reasons.  They will advise you if this
happens.

Department (as below):
 
“the amount of medical marijuana being grown in Australia for use in
medical trials from January 2015 to present.”
 
Section 15 of the FOI Act requires that a request for documents meets
certain requirements.  Your request, in its current form, does not
constitute a valid request. Please note that the Act provides for access
to documents and not to 'information'.  In order for your request to be
processed under the provisions of the FOI Act you must provide us with
further information to enable us to identify the document or documents you
are seeking. 
 
For example, you may wish to consider submitting the following scope:
 
“a document identifying the amount of medical marijuana being grown in
Australia for use in medical trials from January 2015 to present.”
 
Please note that this scope is a sample only.  At this early stage, a
search and retrieval has not been conducted and the TGA is unable to
advise on whether it may be too voluminous to process or if any documents
will be returned. 
 
Alternatively, I would greatly appreciate if you could provide us with
more information on the specific documents that you require.
