Dear Ms Humphris,

 

I am writing about the access application that was transferred to the
University of Sydney from the University of New South Wales

After reviewing the wording of your request, I do not consider that the
application is valid under the GIPA Act and we are not able to progress it
in its current form.

 

The request is not for clearly identified information held by the
University

 

Your request seeks “archived psychometric data and documents of research”
on the I-CAN tool from the Centre for Disability Studies, as well as
material about I-CAN 6 / I-CAN DSOA and “any documents on the proposal” to
the National Disability Insurance Agency (NDIA), including correspondence
between NDIA and CDS.

Based on our initial review, the Centre for Disability Studies is not part
of the University of Sydney in a way that makes its records “government
information held by” the University for the purposes of the GIPA Act. In
practical terms, this means the University does not hold (and is not
required to obtain) documents from that organisation under the GIPA Act.

 

The scope is expressed too broadly to be identified with reasonable effort

 

Even if some related records existed within University systems, the scope
is currently framed in very broad terms (for example, “archived
psychometric data”, “any papers or documents”, and “any documents …
including correspondence”). As written, it is not specific enough for the
University to identify what information is being requested with reasonable
effort.

 

Searches must be reasonably directed

 

Under the GIPA Act, we are required to conduct reasonable searches, but
those searches need to be reasonably directed.

Currently, your application does not indicate where within the University
the relevant records would sit (if they exist), or how they would be
stored.

If you intended to request information held by the University of Sydney,
you will need to provide enough detail for us to target searches, such as:

• which part of the University you believe would have dealt with the
I-CAN tool or related NDIA work (for example, a
faculty/school/unit/clinic/centre),
• any individual(s) you believe were involved (name/title), and/or
• where you think the records might exist (for example, a particular
system, project file, contract file, research administration platform,
shared mailbox, or similar).

 

To help you get to the information you are looking for, you might
consider:

 1. Contacting the Centre for Disability Studies directly to ask for the
I-CAN research materials, archived data, NDIA proposal documents, or
correspondence (to the extent it is held by them). This is likely to
be the most direct path if the documents are held outside the
University.
 2. If you intended to seek records held by the University of Sydney,
replying with a revised scope that includes:

• a defined date range,
• the specific document types you want (for example, final reports
only; published papers only; final versions of proposals only;
specific correspondence only), and
• the University area/system/person you believe would hold the records.

 

If you reply with those details, I can indicate whether the revised
request is likely to meet the GIPA Act validity requirements and be
searchable in a practical way.
