Saturday morning 4th February 2017.
Consequent distant re-routing of the 136 bus

Dear Mr. Ferguson,
I do not appear to have received a reply to my letter emails dated 6 Jun 2017 and 26th May 2017. Copy attached below which includes the reply that I received from Fairfax.

I note that in his letter attached of 26 April 2017 copy attached and which is shown in the attachment and in Figure 1 "Greg Hywood , CEO of Fairfax Media letter of 26 April 2017" .

Greg Hywood , CEO of Fairfax Media states : “I am satisfied that we have acted appropriately and in accordance with all relevant obligations (including permits we obtained) in operating the event. The local Council agrees.”

Could you please confirm whether the Northern Beaches Council or staff has sent correspondence or any other statement to Fairfax which could have led Greg Hywood to believe the above statement that he wrote to me concerning the above event and that “The local Council agrees.”

Please provide me with a copy of the correspondence or any other statement to Fairfax Media or to Fairfax Events that Northern Beaches Council or staff has sent which could have led Greg Hywood to believe the above statement that he wrote to me concerning the above event and that “The local Council agrees.”
Thank you for your assistance,
The full text is in the attached letter.
Sincerely,
Paul Axon .

Locutus Sum left an annotation ()

Mostly I classify a response like this one to say "clarification requested" because the agency has told the applicant that some more information (and money!) is needed before the request will be processed. This time, I have put the response in the category of "refused" because it is three months when the agency has responded and the applicant has not made a follow-up. This does not mean that the agency will refuse the request when an application is made in the correct (required) way and although I have made the classification of "refused", the applicant can use this same request page if he wishes to pursue the request.

Even if the applicant had paid the required fee, the request would in any case be deemed to have been refused by the agency because it was not processed within the required time (s 63 of the GIPA Act of the state of New South Wales).

Dear locutus sum ( aka “He Spoke”),
I saw your annotation (October 09, 2017) on the FOI website.
Could you please identify your role and authority to annotate the record to my FOI request.
I have responded to all requests that I received from the FOI site and Northern Beaches Council.
My request to FOI was submitted on July 04, 2017.
At no time has there been any request for fees
Northern Beaches Council,NBC, has never told me that some more information (and money!) is needed before the request will be processed. They have simply not responded.
On July 04, 2017 Warringah Council promised to get back to me within 10 business days. They did not.
On August 02, 2017 I sent an FOI note to Warringah Council, atn Mark Ferguson, General Manager, Northern Beaches Council, saying “re: my FOI request July 04, 2017 and previously my email Tue, 20 Jun 2017 Please respond to my FOI request as normally required by law“ . There was no reply.
This FOI and Council CSRN 2017/030663) is now subject of an independent internal inquiry by Integrity & Complaints, Northern Beaches Council.
“Northern Beaches Council” promised but did not process this FOI request within the required time (s 63 of the GIPA Act of the state of New South Wales). NBC is now delinquent.
What are the consequences under FOI legislation for the delinquent behaviour of Northern Beaches Council in not responding?
Thank you for your assistance.
Yours faithfully,
paul Axon
