Hi Daniel
thanks for this. I have reviewed the data against the National Crash Data
dashboard and they do not appear to match. It seems that either the data
the Department has supplied or the dashboard is incorrect. 
Can you please have the Department review the supplied data for accuracy,
with reference to the dashboard?
To explain what I mean, here are some example calculations based on the
supplied data.

* 2008 28 drug-related fatalities of 138 fatalities (in jurisdictions
reporting data) = 20%
* 2021 107 drug-related fatalities of 607 fatalities (in jurisdictions
reporting data) = 17%

I am writing to request an internal review of Department of Infrastructure, Transport, Regional Development and Communications's handling of my FOI request 'Data from National Road Safety Data Hub'.

I have reviewed the data against the National Crash Data dashboard and they do not match. It seems either the data the Department has supplied or the dashboard is incorrect.

Can you please have the Department review the supplied data for accuracy, with reference to the National Crash Data dashboard?

Thank you for your email to the Department of Infrastructure, Transport,
Regional Development, Communications and the Arts (the department).

 

We apologise for the delayed response, the department is currently
processing a large number of requests.

 

27 July Email

 

We confirm we have received your follow up email for FOI 23-275 on 27
July, where you raised the issue where you believe the data to be
incorrect.

 

Initially the FOI section was not the best place to lodge this form of
inquiry, however we have followed up with the relevant business area who
have advised:

 

The data supplied in the document released under FOI 23-275 is for all
Road Users not just vehicle controllers (Drivers and Motorcyclists).
However the National Crash Dashboard (NCD) only contains Drivers and
Motorcyclists with the proportions calculated from Driver Fatalities and
Motorcyclist Fatalities separately, not against all Fatalities as in the
document provided under FOI 23-275.

 

Road Safety data is under constant revision. The National Crash Database
(where the document originated) is being updated with 2022 data now. It is
a six month process which is due to be completed in December 2023. This
update also revises previous years data. The National Crash Dashboard will
be updated once a year once the database is completed.

 

The document provided to you under 23-275 contained information accurate
to the date you lodged your request for FOI 23-275 this being 09 May 2023,
and due to the ongoing data update there is an expectation the document
will not align with the NCD charts.

 

If you wish to request the data behind the NCD chart that is strictly
Driver Fatalities and Motorcyclist Fatalities separately, this can be
considered under a separate request.

We hope this answers your query on the accuracy of the data regarding the
NCD.

 

Request for Internal Review

 

We note the decision in FOI 23-275 was issued on 03 July 2023, within this
decision the department advised that you have 30 days to request an
internal review. As such this would have needed to have been lodged by 02
August 2023.

 

However, the decision issued to you provided you access to the document in
full with no information within it to be considered exempt under the FOI
Act. This is classified as an access grant decision for the purposes of
section 53B of  the [2]Freedom of Information Act 1982 (Cth).

 

Due to the decision issued on 03 July being an access grant decision,
internal review is only available to the third parties who had been
consulted on the documents release ([3]section 54A).

 

This is reinforced within Part 9 of the FOI Guidelines issued by the
[4]Office of the Australian Information Commissioner (OAIC).

 

Taking the above into consideration, we do not consider your email dated
21 August 2023 to be a valid request for internal review.

and Motorcyclist Fatalities

4 September 2023 advising you wish to proceed with a new request, and the
department will treat it as a valid request from that date and statutory
timeframes will commence.

administratively outside the FOI process.
