5 May 2021, inquiring about the need for consulting on your FOI request
2021/0028.

 

Documents identified within the scope of your request include information

of Information Act 1982 (FOI Act) to the following:

 

Please provide:

 

1.  a document listing the FOI reference number, title and date of all FOI
requests seeking information related to the Humanitarian Overseas Service
Medal.

 

2.  a document conveying the contact details for the office, branch or
area within Government responsible for investigating breaches of the Prime
Minister's 2018 Statement of Ministerial Standards.

 

Validity of your current request

 

Section 15 of the FOI Act requires that a request for access to documents
under the FOI Act must, amongst other requirements, provide such
information as is reasonably necessary to enable the agency to identify
the document/s being sought.

 

Additional information is required to identify the documents you are
seeking.

 

Part 1 of your request

 

It is unclear from the terms of your request what you mean by ‘title and
date’ of ‘all FOI requests’ seeking information related to the
Humanitarian Overseas Service Medal.

 

Please confirm if:

·         by ‘title and date’ you are referring to the ‘scope’ of the FOI
requests, and the ‘date’ when they were received by the Department; and

·         by ‘all FOI requests’ you are referring to all finalised
requests only. This would include requests that proceeded to a decision
and exclude requests that were withdrawn or transferred.

 

It would also assist the Department to identify the documents you are
seeking if you specify a date range.

 

Part 2 of your request

 

The Statement of Ministerial Standards (the Standards) is published on the
Department’s website at

Section 7 of the Standards provides for implementation, including
investigations of alleged breaches of the Standards.

Regarding Part 2
We seek a document providing a current point of contact with which to report and discuss potential breaches of the Statement of Ministerial Standards. Unfortunately Chapter 7 of the Standards does not provide this detail and we would be grateful for your assistance. Unfortunately the Department has not replied to several administrative requests for this information we have made in recent months.

Thank you for your email dated 6 May 2021, received by the Department of
the Prime Minister and Cabinet (the Department), in which you made a
request to the Department under the Freedom of Information Act 1982 (the
FOI Act) in the following terms:

On 14 May 2021, the Department wrote to you to seek clarification
regarding your request. On 28 May 2021, you responded as follows:

 

Regarding Part 1

We seek a document listing all Humanitarian Overseas Service Medal related
FOI requests made to PM&C from 1 Jan 2020 to today's date.  If related FOI
requests have been forwarded to PM&C from other Department's we would
appreciate those being included. 

 

Regarding Part 2

We seek a document providing a current point of contact with which to
report and discuss potential breaches of the Statement of Ministerial
Standards.  Unfortunately Chapter 7 of the Standards does not provide this
detail and we would be grateful for your assistance.  Unfortunately the
Department has not replied to several administrative requests for this
information we have made in recent months. 

 

Therefore, the Department has taken your request to be for the following:

 

1.       We seek a document listing [the FOI reference number, title and
date of] all Humanitarian Overseas Service Medal related FOI requests made
to PM&C from 1 Jan 2020 to today's date.  If related FOI requests have
been forwarded to PM&C from other Department's we would appreciate those
being included. 

 

2.       We seek a document providing a current point of contact with
which to report and discuss potential breaches of the Statement of
Ministerial Standards.  Unfortunately Chapter 7 of the Standards does not
provide this detail and we would be grateful for your assistance. 

 

Timeframe for receiving your decision

 

We received a valid FOI request from you on 28 May 2021 and the 30 day
statutory period for processing your request commenced from the day after
that date. You should therefore expect a decision from us by 28 June 2021.
The period of 30 days may be extended in certain circumstances. We will
advise you if there is any extension of time.

 

Charges

 

Agencies may decide that an applicant is liable to pay a charge in respect
of a request for access to documents. If the Department decides that you
are liable to pay a charge, we will send you a preliminary assessment of
the charge as soon as possible.

 

Publication of documents

 

Please note that information released under the FOI Act may later be

subject to certain exceptions. If you think you might wish to raise any
objections to the publication of any of the information which may be

Exclusion of officers’ names and contact details

 

For documents that fall within scope of the request, it is the
Department’s policy to withhold:

·         any person’s signature;

·         the names and contact details of Australian Public Service
officers not in the Senior Executive Service (SES);

·         the mobile or direct numbers of SES officers;

·         the names and contact details of Ministerial staff at a level
below Chief of Staff.

 

The names and other details of SES officers will not be withheld unless
there is some reason for that information to be exempt from release. If
you require signatures, the names and contact details of non-SES officers
or Ministerial staff below the level of Chief of Staff, or the mobile or
direct numbers of SES officers please let us know at [3][DPMC request email] so
the decision-maker may consider; otherwise we will take it that you agree
to that information being excluded from the scope of your request (that
is, the information will be treated as irrelevant and redacted from any
documents for release).
