Note I am not asking for individual emails etc between schools and the department - I am requesting all documents that describe My Mind Check, and were provided to schools, either upfront or upon their request, to inform them about the program.

I refer to your request, received by the Department of Education
(department) on 16 June 2025, for access under the Freedom of Information
Act 1982 (FOI Act) to the following:
“I request, under the Freedom of Information Act, the general
documentation provided to schools as part of the My Mind Check program.”
In your request you noted that you are ‘not asking for individual emails
etc between schools and the department - I am requesting all documents
that describe My Mind Check, and were provided to schools, either upfront
or upon their request, to inform them about the program’.
Your request was received by the department on 16 June 2025 and the 30 day
statutory period for processing your request commenced from the day after
that date. The period of 30 days may be extended if we need to consult
third parties or for other reasons permitted under the FOI Act. We will
advise you if this happens.
Charges
The department will advise you if a charge is payable to process your
request and the amount of any such charge as soon as practicable. No
charge is payable for providing a person with their own personal
information.
Your address
The FOI Act requires that you provide us with an address that we can send
notices to. You have advised your electronic address is

Disclosure log
Information released under the FOI Act may be published on a disclosure

Publicly available material
We have been advised that the My Mind Check website
([1]https://mymindcheck.org.au/) and the related YouTube channel
([2]https://www.youtube.com/@MyMindCheck) contain some general information
that is provided to schools to inform them about the program. For example,
the My Mind Check website contains the program’s [3]privacy collection
notice and [4]portal terms of use and the YouTube channel includes
informative videos often circulated to schools such as the programs
introductory video ([5]https://www.youtube.com/watch?v=ERNpi6dE...). As
such, we have excluded any of this publicly available material from the
scope of your request.
Interpretation of request
The department has interpreted your request to be seeking access to ‘any
general documents that describe the My Mind Check program which have been
provided to schools, either up front or upon request, to inform them about
the program’. We note that this does not include publicly available
materials, documents provided to schools after they have signed up to the
program or emails between schools and the department.
If we have misinterpreted your request, please let us know by COB
Wednesday 9 July 2025. If we do not hear otherwise from you by that date,
we will proceed on the basis that we have correctly interpreted your
request.

Dear Vanessa,
Thank you for your email.
As advised in the charge notice dated 11 July 2025, the timeframe for
processing your request has been extended by 30 days under the FOI Act to
allow for consultation with third parties. As your request covers
documents that contain information about the business, commercial, or
financial affairs of an organisation, we need to ask that organisation
about releasing their information before making a decision on your
request.
I also note that under the FOI Act, the time for processing your request
was suspended from the day we sent you the charge notice (11 July 2025)
until the day following your payment of the charge (payment was made 28
July). For completeness, further information on the time limits for
processing your request is also outlined in the charge notice sent to you
on the 11 July 2025.
Based on this, the statutory due date under the FOI Act for the decision
on your request is 1 September 2025.
