I refer to your request for access to documents relating to webform ID 2024513103636-3312 under the Freedom of Information Act 1982 (FOI Act). I have taken your request to be for:
a) all documents (including documents saved to the Commission's document management systems) created as part of the assessment process for the referral with webform ID 2024513103636-3312;
b) to the extent not covered by a), any and all documents setting out the outcome of the assessment of the referral (including reports).
Can you please confirm if the scope of your request excludes duplicates of documents, drafts, URLs, telephone numbers, email addresses, and names of staff members unless they are Statutory Office Holders.
Identification details
This request is seeking information regarding an identified referral to the Commission. There are specific protections for referrers under the National Anti-Corruption Commission Act 2022 and the Commission takes confidentiality very seriously (https://www.nacc.gov.au/protections-refe...).
While the FOI Act does not require you to disclose or provide proof of your identity, the Commission's decision in relation to this FOI will necessarily have to consider the provision of personal information if it is included in the relevant documentation. Should you wish to provide some form of identification to the Commission such as a certified copy of your driver's license, this will be considered in the decision on the application of any relevant exemptions for your request. Any information you provide will be handled in accordance with the Privacy Act 1988. Administration of your FOI request
We received your request on 10 November 2025 and the 30 day statutory period for processing your request commenced from the day after that date. You should therefore expect a decision from us by 10 December 2025. The period of 30 days may be extended if we need to consult third parties or for other reasons. We will advise you if this happens.

In your email of 12 November 2025 you asked:

The scope of my request excludes duplicates of documents.
The scope of my request excludes drafts of documents.
The scope of my request does NOT exclude URLs. If URLs are to be redacted, there must be a lawful exemption upon which reliance is to be placed.
The scope of my request does exclude telephone numbers, unless they are published online.
The scope of my request does NOT exclude email addresses. If email addresses are to be redacted, there must be a lawful exemption upon which reliance is to be placed.
The scope of my request does NOT exclude the names of staff members. If the names of staff members are to be redacted, there must be a lawful exemption upon which reliance is to be placed (e.g. s 47F of the FOI Act).
ERRORS IN CORRESPONDENCE ABOUT DATES THE REQUEST WAS RECEIVED AND THE DECISION IS DUE
In your email of 12 November 2025 you noted:
“We received your request on 10 November 2025 and the 30 day statutory period for processing your request commenced from the day after that date. You should therefore expect a decision from us by 10 December 2025.”
Those statements are incorrect.
Pursuant to section 14A of the Electronic Transactions Act 1999 (Cth), the NACC received my FOI request on 7 November 2025 (also see paragraph 7.83 of the FOI Guidelines). I have a digital certificate noting that my request entered the NACC's FOI inbox on 7 November 2025.
The NACC's decision is due on 8 December 2025, and not on 10 December 2025.
