documents held by the Classification Board (the Board) under the Freedom
of Information Act 1982 (FOI Act).  Please note that the Department of
Infrastructure, Transport, Regional Development, Communications and the
Arts (the Department) provides the Classification Board with
administrative assistance in relation to FOI requests.

Timeframes

The statutory due date for you to receive a decision on your request is 12
March 2023. This date may be extended in certain circumstances, and in the
event that this occurs, the Department will notify you.  Where the due
date falls on a Saturday, Sunday or public holiday, the timeframe will
expire on the next working day.

I refer to your request dated 10 February 2023 seeking access to documents under the Freedom of Information Act 1982 (FOI Act).

I also thank you for your email of today's date, received at 06:46AM.

The statutory due date of your request, as advised on 16 February 2023, was 12 March 2023. That day fell on a Sunday. In addition, Monday 13 March 2023 was a public holiday in the ACT, where we are located.

Section 36(2) of the Acts Interpretation Act 1901 provides that where a statutory due date falls on a weekend or public holiday, then the action required may be done on the next working day. As such, the statutory due date for your request is in fact today, 14 March 2023.

In order to finalise this request, please find attached a decision on access, together with the documents referred to in that decision.

Section 11C of the FOI Act requires publication of documents released under the FOI Act on the Department’s FOI disclosure log, subject to certain exceptions, including where publication of personal, business, professional or commercial information would be unreasonable. The documents released to you will be published on the disclosure log within 10 working days.
