FOI Request: FA 23/02/01304
File Number: FA23/02/01304

Dear MBV,

I refer to your email dated 21 February 2023 in which you request access to documents held by the Department of Home Affairs (the Department) under the Freedom of Information Act 1982 (the FOI Act).

I am writing to advise that your request is not valid for the purposes of section 15(2)(b) of the FOI Act in its current form, and to provide you with an opportunity to revise your request so that it is a valid request. This is called a ‘request consultation process’. Please respond to this notice in one of the ways set out below.

Scope of Request
You have requested access to the following:
I seek access to the following documents:
All documents and correspondence relating to the drafting and distribution of the Minister's Media Release 'Australian women and children repatriated from Syrian Camps' (29 October 2022).
This request includes any drafts of the media release, internal communications, and any communications between the Minister's office and the Department.

Power to refuse request
Section 24 of the FOI Act provides that if the Department is satisfied that a practical refusal reason exists in relation to a request, the Department must undertake a consultation process with you, and if, after that consultation process, the Department remains satisfied that the practical refusal reason still exists, the Department may refuse to give you access to the documents subject to the request.

Practical refusal
A practical refusal reason exists if either (or both) of the following applies:
(a) the work involved in the processing of the request would substantially and unreasonably divert the resources of the Department from its other operations
(b) the request does not satisfy the requirement in section 15(2)(b) of the FOI Act, which requires you to provide such information concerning the document you are seeking access to, to enable the Department to be able to identify it.

Reasons for practical refusal
The Department has considered the scope of this request and its capacity to conduct searches of relevance based on the current scope. It is my preliminary view that your request, in its current form, is not specific enough to enable the Department to identify documents in scope of your request.

In order to process your request in a timely manner, FOI and the relevant business area require your assistance to clarify the scope of your request.
Please clarify the following points of the scope of your request:

The phrase 'All documents and correspondence' is too broad.
Please identify the specific documents you require access to. For example, briefs, plans, emails.
The Department recommends you limit the scope of your request to the final versions.
Also, please provide a date range for the documents you require access to.

Request Consultation Process
You now have an opportunity to revise your request to enable it to proceed.
Your request is currently not a valid request for the purposes of section 15(2)(b) of the FOI Act. As part of this practical refusal consultation, you have 14 days to do one of the following:
• make a revised request;
• indicate that you do not wish to revise your request;
• withdraw your request.
If you do not do one of the three things listed above during the consultation period (14 days) or you do not consult the contact person listed below during this period, the Department will deem your request to be withdrawn.
Contact
Should you wish to revise your request or have any questions in relation to this process, please do not hesitate to contact the FOI section at [Department of Home Affairs request email]

Kind regards,

FOI Officer - Geoff

Dear MBV

I write to advise that on 1 June 2023 the Office of the Australian
Information Commissioner (the OAIC) received an application from the
Department of Home Affairs (the Department) for an extension of time, to
process your FOI request of 21 Feburary 2023.

The Department has applied for further time to deal with your request

provided you with notice of a decision.

Please find attached a copy of the reasons provided by the Department in
support of its application.

The Department has requested an extension to 11 June 2023. The decision
maker at the OAIC will take any comments you may have to make into account
when deciding the application.

Please respond to this email by close of business 7 June 2023. If I do not
hear from you by this date, the decision maker will make a decision on the
basis of the information provided to the OAIC by the Department.

You will be notified of the decision once the matter has been finalised.

Further information about extension of time requests may be found on our
website at [2]Extensions of time.

FOI requests are generally processed in the order they are received.

We will contact you as soon as the Department has assessed your request
under the FOI Act.

We’re responding to a large volume of requests

Due to the current high volume of requests, we will not provide progress
up-dates on current FOI requests.  This is to ensure we are able to
process as many requests as possible, including yours.

If processing your request is going to take us a lot of time and because
it is large or unspecific, it may be refused.

FOI request: FA 23/02/01304-R1

File number: FA23/02/01304

Dear MBV

Invalid Freedom of Information internal review request

Thank you for your email requesting an Internal Review of your Freedom of
Information request FA 23/02/01304.

The Department has determined that your request for internal review is
invalid, by the operation of section 54E(b) of the Freedom of Information
Act 1982 (the FOI Act).

Section 54E(b) provides that internal review is not available for
decisions that an agency has been taken to have made under section 15AC of
the Act.  Section 15AC of the FOI Act applies when an agency is deemed to
have refused an FOI request because it did not make its original decision
on the request during the request’s statutory timeframe (30 days, plus any
additional time the FOI Act provides for extension or consultation).

On 12 June 2023, the Department was deemed to have refused your original
request under Section 15AC because it had not made its decision on your
request by 13 June 2023, the last day of the statutory timeframe
prescribed by the FOI Act.

The Department is only able to conduct internal reviews on decisions, and
no decision has been made on your request.

As a result, the Department is unable to take any action on your request
for internal review.

Other options for review: Information Commissioner review

You may instead apply for a review of the Department’s access decision by
the Office of the Australian Information Commissioner, via the following
means:

Online:              [1]www.oaic.gov.au

Post:                  GPO Box 5218 Sydney NSW 2001

Fax:                    +61 2 9284 9666

Email:                [2][email address]

More information about Information Commissioner review is available on the
Office of the Australian Information Commissioner website at
