Environment and Regulation Redland City Council
Dear Redland City Council,
Under the Right to Information Act 2009 (Qld), I respectfully request access to all documentation, correspondence, and internal notes relating to the seizure, investigation, and ongoing detention of two registered dogs from the property at 261 Avalon Road, Sheldon QLD 4157, on 11 April 2025 by Cohen Holloway.
Specifically, I seek access to:
1. Any complaint(s) made to Council relating to the alleged dog incident on, around or before 11 April 2025.
2. Any incident reports, officer notes, attendance logs, or internal communications from Compliance Response Officers relating to this matter.
3. Any photographs, videos, bodycam footage, or witness statements gathered in relation to the alleged dog attack.
4. Any documentation discussing or deciding upon the holding period, refusal of release, or requirement for property inspection prior to release.
5. Any internal emails between Council staff referring to the case, its legal basis, or actions taken between 11 April 2025 and today’s date.
This information is requested to understand the basis on which Council continues to detain the dogs without issuing a formal dangerous dog declaration or providing substantiating evidence.
If any part of the information is exempt from release, please provide reasoning and release the remainder under administrative release or the RTI Act’s partial access provisions.
Yours faithfully,
Jake Kersley

Dear Council,
I am writing to formally request that Redland City Council provide, without requiring a paid RTI application, all records, evidence, and internal documentation relating to the seizure and ongoing detention of my two dogs, Lexi and Max, associated with CRAM555987 and the alleged incident on 11 April 2025.
I believe this material falls within the scope of an administrative release under the Right to Information Act 2009 (Qld), as it:
Directly relates to me and my registered animals;
Is being used by Council to make enforcement decisions that affect my legal rights;
Has not been made available to me despite multiple formal requests.
It is neither transparent nor procedurally fair for Council to rely on undisclosed records to restrict the return of my animals while simultaneously refusing to provide access to those same documents unless I pay a fee.
I respectfully request a written response within 48 hours, confirming whether this material will be released administratively. If not, please provide written justification outlining why this information cannot be disclosed outside of a paid RTI application.
Kind regards,
Jake Kersley

Good afternoon Mr Kersley,
Council’s Administrative Access scheme is designed to give individuals’
access to information not ordinarily available or cannot be obtained by a
paid search.
If the document does not contain any information which would be considered
to be exempt or not in the public interest, it may be released
administratively by Council.
Where the document contains the personal information of a third-party
individual, this would require Council to consider the disclosure rules
contained in the Information Privacy Principles and would likely be
considered under the Right to Information Act 2009 or the Information
Privacy Act 2009.
Based on the information you have provided, your request for information
would not be suitable for release under Council’s Administrative Access
scheme as I would be required to consider:
1. whether there is any exempt information contained in the
documents,
2. public interest factors favouring disclosure and/or
non-disclosure of the information; and
3. whether consultation with third parties is required.
As advised on 16/04/2025, your application is not compliant in its current
format. Please refer to the information provided to you to further assist
with this process or contact the Ethics & Integrity Unit should you
require help with completing the application form.
Warm regards,

Please note as previously advised, Council is unable to process access
applications that require customised reports to generate specific
documents. To provide you with the requested documents Council would be
required to create a customised report (a document) not ordinarily
available from our database, therefore Council would be creating a
specific document that did not exist at the time of your application.
Should you wish to proceed with the application, it is likely to be
refused on the basis that it is non-existent.
