Dear FOI,

Thank you for your email. We offered references to assist your searches.

The Australian Senate had a continuing order which required departments and agencies to provide to the Senate a list of indexed lists of files created by them. The Senate advised us that the file number and title we referred to was created by AGDs.

The Office of Parliamentary Council identified 29 documents related to ‘a file with number 12/5946 relating to the HOSM Amendment Regulation: Iraq clasp’. The office advised they included your department’s related documents. We requested administrative access to information to inform FOI requests. Your department was unable to assist ‘The Department has taken reasonable steps to provide access to the information requested on an administrative basis, and we now consider your request to be finalised.'

Thank you for your emails dated 3 and 4 August 2021 (attached), received
by the Department of the Prime Minister and Cabinet (the Department).

 

Validity of your request under the FOI Act

 

Section 15 of the Freedom of Information Act 1982 (FOI Act) requires that
a request must, among other requirements provide such information as is
reasonably necessary to enable the agency to identify the document/s
sought. Your request, as currently framed, does not provide sufficient
information as is reasonably necessary to enable the Department to
identify the documents sought, and your request is therefore not valid
under the FOI Act.

 

In your request of 3 August 2021, you referred to records/files held by
the Attorney General’s Department and the Office of Parliamentary Counsel
(OPC), and mentioned that the Department ‘holds documents related to these
matters’. You then requested that the Department provides ‘a copy
excluding gazetted HOSM Letters Patent, Regulations or Declarations; and
public HOSM applications.’

 

Following a request for clarification from the Department, you stated as
follows in your email of 4 August 2021:

 

Office of Parliamentary Council identified 29 documents related to ‘a file
with number 12/5946 relating to the HOSM Amendment Regulation: Iraq
clasp’.  The office advised they included your department’s related
documents.

 

The information you have provided does not clarify for the Department what
documents you are seeking.  If you wish to access documents held by OPC,
you may contact their FOI Coordinator by sending an email to
[1][email address] and providing them with information about the documents
you wish to access.

 

As your request is currently not valid under the FOI Act, the statutory
processing period for responding to your request has not commenced. We
will take no further action in relation to your request unless we hear
from you.

Thank you for your email. Please accept my apologies. We thought those references were of some assistance.

On 7 Nov 2019, OPC corresponded with your department ‘FOI Consultation - Humanitarian Overseas Service Medal Declaration [DLM=Sensitive:Legal]’. These consultations related to the documents we seek from your department. The document shows the relevant SES Mr Rush was to be informed of the above. I suspect he would be able to assist in identifying the documents.

Can I ask if we are expected to name the documents in order for your department to consider it a valid FOI request?
