The purpose of my email is to seek your agreement to extend the processing
period for your request. Further information about this, including my
reasons for requesting an extension from you, has been set out below for
your consideration and response.  

 

Extension of Time Request

Under s 15AA of the FOI Act, an agency may extend the initial processing
period for dealing with a request by a further period of no more than 30
days if the applicant agrees in writing to the extension and the agency
gives written notice of the extension to the Information Commissioner as
soon as practicable after the agreement is made.

 

I would like to request your agreement to extend the processing period for
your request by 25 days. I am requesting this extension of time from you
to ensure the department has sufficient time to process and finalise your
request in accordance with the FOI Act. Please be assured that we are
working to process your request as quickly as possible however, due to the
volume and complex nature of your request, significant internal
consultation regarding potential disclosure of documents is required.

 

If you agree to the requested extension of 25 days, please let me know in
writing at your earliest convenience.

 

The department received your request on 23 October 2023 and the 30 day
statutory period for processing your request is currently 23 November

Please be advised that the department is currently coordinating and pulling together the list for further assessment. As you can appreciate, this request has resulted in a large internal consultative exercise and has generated a comprehensive list which has been created under section 17 of the FOI Act.

Whilst it is still too early to confirm whether the statutory deadline of 18 December 2023 deadline will be met, I would be happy to provide you with a further update early next week. Can I ask the reasoning for the request to exclude the nine topics?
I would think that most topics raising the name of individuals would be covered by current existing exemptions of personal privacy.

For the judicial, and AAT appointments I do not believe it is necessary to remove these submissions as this is public information that is required to be made public that they have been appointed and for AAT members – reappointed.

On secretary leave requests, I am okay to have them exempted.

I am personally minded to allow the remainder to follow a similar format below, where possible I’ve included an example:

Parole consideration – crime of accused [name redacted]
Extradition request Country name should be included - I.e Extradition request to United Kingdom for [name redacted]
International transfers of prisoner - redaction of individual, but not the country the prisoner was requesting to go to or come from. i.e International transfer of prisoner from [redacted country] to Australia for [name redacted]
Consent to prosecute – [name redacted]
Post Sentence order apps/consideration: Post sentence order application/consideration for [name redacted]
Settlement request – party v party to be included.

Thank you for your response and agreement to exclude ministerial submission titles relating to Secretary Leave requests.

The rationale behind seeking exclusion of the topics outlined below is based on what will be released once relevant exemptions are applied (i.e. s 47F) That is, there will be little substance to the remainder of the ministerial submission title. For example, Parole consideration (redaction of name) or Post Sentence order application (redaction of name) etc etc.

As you so rightly outline - Judicial and AAT appointments/reappointments are already made public and therefore was the rationale behind seeking exclusion of these ministerial submissions.

I would be grateful if you might reconsider excluding those titles listed below.

While I understand the reasons provided, I still think it is appropriate for the ministerial submission number to be public, and the creation date of them would be beneficial in the public arena.

As it has been seen in the recent media about certain post sentence arrangements and whether or not the Department/Attorney had done the work previously - I believe it is in the public interest for Australians to have access to that, even if the name of the individual is not public.

On the Judicial/ AAT appointments, I think it is still important for the public to be aware of when the appointment submissions were created within the department, and their number, and for those reasons do not believe they should be excluded either.

I am writing in relation to FOI23/548 to seek your agreement to a staged
approach to the release of documents, and to seek your support for a
section 15AC extension request to the Office of the Australian Information
Commissioner (OAIC).

 

The FOI Guidelines state at the following weblink that ‘where a request
relates to a large number of documents, it is open to an agency and
applicant to consult and agree on a staged approach to the release of the
documents’.

Given the volume of documents relating to this request and the significant
number of internal and external consultations required, the department
seeks your agreement to a staged release of documents in 2 tranches.

 

If you agree to this approach, subject to the decision maker’s final
decision, the department intends to release to you approximately 50% of
the material falling within the scope of this request, in tranche 1.

 

As you would be aware, this request was due on 15 January 2024.
Unfortunately, due to the volume of documents relating to this request,
the department was unable to finalise it within the statutory timeframe.
Please be assured that the department is continuing to actively process
your request and would appreciate if you would consider supporting the
department in seeking a 15AC extension of time request to the OAIC for a
period of 60 days to provide you with a final decision. This would take
the statutory due date to 15 March 2024.

 

On 5 January 2024, we advised you that a number of consultations with
identified parties are required in relation to your request – the above
extension of time would enable the department to finalise  necessary
consultations and collate feedback received in those processes. Where the
department disagrees with third parties’ contentions it would also enable
the department to further consult with the relevant parties before the 15
March 2024 deadline.

 

If you were to support the s 15AC extension of time request by the
department, we would propose releasing tranche 1 of the documents to you
by 9 February 2024 and releasing tranche 2 by 15 March 2024.

 

With apologies for the short time provided, the department would
appreciate your response to this email by COB 1 February 2024, given the
proposed due date for tranche 1 is approaching. Please let us know if you
require additional time to respond to this email. Alternatively, I’m more
than happy to discuss this with you by phone. I do not have your telephone

department’s correspondence of 30 January 2024 and confirmed you were

In my correspondence of 30 January 2024, I stated that the department
intends to release Tranche 1 of the material to you by 9 February 2024.
The purpose of this email is to inform you that the department will be
unable to release Tranche 1 by this date, however this matter remains a
priority for the department and we intend to provide it to you as soon as
possible.  

 

I am also writing to you today to discuss the department’s intention to
submit an extension of time request to the Office of the Australian
Information Commissioner under s 15AC of the FOI Act. Noting that you did
not comment on this in your correspondence of 1 February 2024, I’d be
grateful if you could please confirm whether you would support our
extension of time application, to extend the due date to the 15 March

Thank you for your email. The department apologises for the delay in
getting this decision to you and thanks you for agreeing to support an
extension of time. While the department appreciates your support for a new
extension, the department is not intending to lodge a section 15AC
extension of time request to the Office of the Australian Information
Commissioner (OAIC) at this point in time. OAIC has advised that it will
only provide extensions of time in “exceptional circumstances” and our
recent experience has been that voluminous requests such as this one have
not met its threshold.

The department is continuing to process your request and at this stage
intends to finalise the decision by early May.
