Dear Department of Immigration and Border Protection,

I hereby request, under the Freedom of Information Act 1982 (Cth),
copies of the following documents:

1) Documents including CCTV footage or body worn cameras from any premises either run by or otherwise provided to or managed under contract on behalf of the Department of Immigration and Border Protection (DIBP) or any other government department that reports to or is otherwise related to DIBP on Nauru from 17 to 20 July, 2013.

I also make the application that all costs for the processing of
this request be waived on the grounds that the release of this
information is in the public interest, will enhance the
transparency of the process, and aid the public debate surrounding
government policy.

This email address is valid for the purposes of s15(2)(c) of the
Freedom of Information Act 1982 (Cth).

I am writing to inform you that I have been appointed as the authorised
decision maker for your FOI request, seeking access to:

 

CCTV footage or body worn cameras from any premises either run by or
otherwise provided to or managed under contract on behalf of the
Department of Immigration and Border Protection (DIBP) or any other
government department that reports to or is otherwise related to DIBP on
Nauru from 17 to 20 July, 2013.

As part of the department’s FOI service standard, I will update you every
14 days regarding the progress of your request, however please do not
hesitate to contact me if you have any questions.

 

The current due date for your request under the FOI Act is Tuesday, 22
April 2014.  

Due to the number of requests currently being processed by our office, the
fact that this matter was only allocated to me today and the upcoming
public holidays, it is unlikely that I will be able to finalise your
request by the original due date. 

I therefore seek your agreement (under s.15AA of the FOI Act) to extend
the timeframe for the processing of your request by 30 days.  This would
extend the due date for your request to Thursday, 22 May 2014.

Please advise by close of business Friday, 11 April 2014 whether you agree
to this request for an extension of time.

Department of Immigration and Border Protection (DIBP) or any other
government department that reports to or is otherwise related to DIBP on
Nauru from 17 to 20 July, 2013.

The current due date for your FOI request is Tuesday, 22 April 2014.

 

The purpose of this email is to advise you (as required under s.24AB of
the FOI Act) that I consider a 'practical refusal reason' exists under
s.24AA of the Freedom of Information Act 1982 (FOI Act) in relation to
your request.  I have set out my reasons in the attached notice. 

 

The FOI Act requires that you respond to this notice before the end of the
consultation period, which is close of business Australian Eastern
Standard Time (AEST) Friday, 25 April 2014. However as this is a public
holiday, the Acts Interpretation Act 1901 provides that the latest date
you may respond is the next working day, which is Monday, 28 April 2014.

Purpose of this email

 

I am writing to you about the s.24AB notice that I sent to you on 11 April
2014. The consultation period under the FOI Act expired at close of
business on Monday, 28 April 2014. As you did not respond to me by the end
of the consultation period, your request is now deemed to be withdrawn as
at close of business on the last day of the consultation period, which was
Monday, 28 April 2014.

 

The attached notice provides more detail.
