NBN Rollout Statistics as at 30th April 2013

Dear NBN Co Limited,

I refer to my previous FoI request (NBN reference: FOI1213/19.23) and the Statement of Reasons from that request, specifically point 12 where it states:

"In that context [referring to point 11], NBN Co staff informed me that it would be possible to establish preliminary or draft figures in line with the Applicant's request by drawing information from various NBN Co databases. As permitted by section 17 of the FOI Act, it would then be possible to create a new document containing the relevant information."

Granted the determination of NBN Co above that it is possible under the FOI Act to request the information regarding the rollout progress, I hereby request the following statistics on the NBN rollout, as at 30th April, 2013.

1) Brownfields Fibre Rollout
a) Number of premises under construction;
b) Number of premises passed (able to order a service);
c) Number of premises with an active Brownfield Fibre NBN service.

2) Fixed Wireless Rollout
a) Number of premises covered by an 'actively under construction'
tower site;
b) Number of premises covered by active tower site (able to order
a service);
c) Number of premises with an active Fixed Wireless NBN Service.

3) Interim Satellite coverage
a) Number of premises with an active Interim Satellite NBN
Service.

Notwithstanding the information at point 13 in FOI1213/19.23 to ensure accuracy and completeness of data, or at point 17 that NBN Co plans to release similar data at Budget Estimates, and point 19 that the information would be able to be made public around 60 days after the reporting date, I fully expect that NBN Co will not be able to provide this information inside the 28-day legislated period of determination. However I would expect that the information could be made available after a period of deferral under section 21(1)(b) of the FOI Act.

Dear David,

Although I am aware of that information, it is as at June 30, 2013 and does not fulfil the original FoI request.

As I believe that NBNco has been evasive on this request and others, I am marking this request closed, and that you have refused to provide the information.

I am very disappointed in the lack of transparency shown by NBNco in this regard.

Mr Dickins,

I never made any indication that I was finalising this FOI request. As per my decisions, the release was deferred until an external review, due later this month. That has not changed.

You had previously complained that I had not made you aware of media releases relating to rollout statistics. As I outlined previously, those releases are not in my control. This press release came to my attention today and I presumed you would be interested in the information.
