Dear NSW Office of State Revenue,

I would like to request the number of fines that have been issued for smoking in contravention of Smoke-free laws, including Smoke-free Environment Act 2000 and Smoke-free Environment Regulation 2016 as well as any Council mandated smoke free areas during the past 2 years.

If feasible, I would like the data to be formatted:
Entity - Period (2017 Dec or 2017 Q4) - offence - number of fines

Thank you for your enquiries about smoking contraventions and parking
offences.

 

Smoking

I am pleased to advise that this information is publicly available on the
Revenue NSW website at [1]http://revenue.nsw.gov.au/info/statistic...
go to Open data: Penalty notice data set.

 

You can then filter by the legislation, Smoke-Free Environment Act 2000,
or perform a key word search 'smoke' which will also bring up offences
like smoking on a public passenger vehicle, smoke in motor vehicle with
kids etc which are under public transport or road rules legislation.

 

Parking offences

Parking fine information is also available on the Revenue NSW website at

1. I clicked both of the links but they don’t work.
2. Where can I report the people smoking on trains and platforms.
It’s almost every platform people are smoking.
3. Who are the officers enforcing this law?

Dear GIPA-DFSI,

The dataset is quite large and required some effort to sort through, may I suggest some SQL type fiiltering be allowed before downloading the dataset?

Also, there is no breakdown of the agency responsible for issuing the infringements, is this available elsewhere?

I refer to your informal request for information made under section 8 of
the Government Information Public Access Act 2009 (the GIPA Act).

 

Searches for information

 

Revenue NSW conducted searches for information that fell within the scope
of your request.

 

Revenue NSW did a search for fines issued for contraventions of smoking in
non-permissible areas in the 2016/17 and 2017/18 financial years. Revenue
NSW generated a report that provides a breakdown of smoking contravention
by Issuing Authority.

 

I have decided, in accordance with section 8(1) of the GIPA Act, that
there is no overriding public interest against releasing this information
to you.

 

Therefore, the information requested is attached.
