Partner Visa, All Previous Requests Via Email Ignored

Dear Department of Immigration and Border Protection,

previous requests for all documents regarding my partnership visa that was denied and then cancelled have been ignored and a request of a recording of a telephone call placed to the immigration department has also been ignored

the department claims that 1 email is a reasonable attempt to contact applicant's before denying and cancelling a visa, i'm wondering if the department is talking about the membership of the local tennis club or a matter that involves 2 people's lives ??

and the little check box for communication via fax or email reads

if you tick this box the department -->MAY<-- contact you with this method

and it mentions something along the lines of choosing this method help speed up the processing, so when your talking about something like a partnership visa that has very long processing times people will tick that box to possibly speed up the processing of the application.

what it doesn't say is if you tick this box we will cease any other form of communication even if you don't response for our initial email and you and your partners lives will be thrown into a spin cycle all because we believe that 1 email is a reasonable attempt of contact for such a serious matter involving whether or not you and your husband (foundation rock) can remain together in this country.

if you do become unlawful as a result of this sneaky ploy you can always spend tens of thousands of dollars to remain with the most important person in your life who you cannot ever imagine being apart from.

well at least the last paragraph is an option

explain why my requests for my information over 2 years ago are being ignored ??

Dear FOI,

I have already completed a 424A and emailed to [email address] on 2 occasions 2 years ago
I did not receive any response on both occasions.

can someone please explain why I was ignored twice 2 years ago

I recently stumbled on to the rightoknow website so I made a request and within 24 hours I received a response.

To be honest I don't think I should even bother contacting the department outside of this website , will I be ignored again, should I waste more of my time or should I continue writing the letter that I will be sending to commissioners,ombudsman,minister's and senators.

Hi Hau

Go through the proper procedures to apply for your records. If they provide a response and you are not happy with the reply then you can request an internal review within 30 days of the decision.

If there is no decision and there are long delays then you can email the FOI section to follow up. Since you have applied twice and there have been no decisions, you could probably follow up on these rather than lodging a new FOI application.

If there is still a delay or you are unhappy with the decision, you can lodge a review or complaint through OAIC. See https://www.oaic.gov.au/freedom-of-infor...

OAIC is fast and immigration will likely work on your case quickly once it receives the complaint.
