James Smith made this Freedom of Information request to Australian Radiation Protection and Nuclear Safety Agency

Australian Radiation Protection and Nuclear Safety Agency did not have the information requested.

From: James Smith

Delivered

Dear Australian Radiation Protection and Nuclear Safety Agency,

This is a request under the Freedom of Information Act.

I request documents related to the ten most recent instances where an employee has sought information, advice, guidance, or opinion on their social media use in a private capacity.

I limit the scope of documents to:
- the original request from the employee
- the agency/department's response
- any follow-up questions and response
- only those sent to a relevant HR / conduct / social media (or similar) team (rather than managers across all areas of the organisation)
- where the original request was created in the last 2 years

Should you have any questions please do not hesitate to contact me.

Yours faithfully,

James Smith

Dear Mr Smith,

We have received your request to obtain documents related to the ten most recent instances where an employee has sought information, advice, guidance, or opinion on their social media use in a private capacity. I note the limitations you have placed on the scope of your request.

I can confirm that the Australian Radiation Protection and Nuclear Safety Agency (ARPANSA) has not in the last two years received any requests from employees seeking information, advice, guidance, or opinion on their social media use in a private capacity and as such no documents falling within the scope of your request exist.

Section 24A of the Freedom of Information Act 1982 provides, in part, that:

(1) An agency or Minister may refuse a request for access to a document if:
(a) all reasonable steps have been taken to find the document; and
(b) the agency or Minister is satisfied that the document:
(i) is in the agency’s or Minister’s possession but cannot be found; or
(ii) does not exist

I must therefore refuse access, pursuant to section 24A of the FOI Act on the basis that the document[s] sought do not exist or cannot be found. You are entitled to seek review of this decision and your rights in this regard are set out the attachment to this email.

Regards,

Martin
