issued by the Australian Information Commissioner, the timeframe will
expire on the first day following which is none of those days.

 

In accordance with section 15(5)(b) of the FOI Act, the decision on your
request would be due on 3 August 2022, however due to this date being a
Sunday, your request is currently due on 5 August 2022.

 

When the processing period may be extended or suspended

The current due date may be extended by up to 30 days if agreed by you
(section 15AA of the FOI Act). The due date may also be extended by an
additional 30 days in each instance, if your request is considered

1982 (the FOI Act), made on 13 July 2022.

 

I am writing to you because at present, the scope of your request is too
large for the Department to process.

 

While your request in its current form excludes duplicates it specifically
includes all different or updated versions of a document. This may include
documents which are not currently held on our Parliamentary Document
Management System (PDMS). This would require a significant number of
searches across the Department. Due to the number of searches required,
the Department considers that a practical refusal reason exists as
outlined in [1]section 24AA of the Freedom of Information Act 1982 (FOI
Act).

 

Invitation to revise scope

I am now writing to provide you with an opportunity to engage with the
Department to revise the scope of your request, to remove the practical
refusal reasons informally.

 

You may wish to consider revising the scope of your request to focus on
the current version of QTBs as held in the PDMS as at the date of your
request. We have undertaken a preliminary search of the QTBs that were
held in PDMS as at the date of your request and many of them have a number
of versions. These different versions may be identical and simply created
during the PDMS QA process but each version would have to be compared to
the subsequent version in order to provide you with all versions as you
have requested. One of the QTBs has over 100 versions while a significant
number of others have more than 40 versions.

 

Any draft version of a QTB would also have to be assessed for deliberative
matter. Although not all draft versions of documents are considered
deliberative, and whilst deliberative matter that subsequently formed part
of the final released document may not present a problem in itself, other
matter that was being deliberated, but that did not form part of the final
released document may be exempt under section 47C of the FOI Act. Given
the number of documents involved, assessing all draft documents for
deliberative matter would substantially and unreasonably divert the
resources of the agency from its other operations.

 

You would of course be free to make subsequent FOI requests in relation to
those QTBs in which you have the most interest.

 

Next steps

Please respond by 12.00 noon 19 August 2022 to indicate whether you wish
to:

a)       revise your scope; or

b)      keep your scope as it is.

Request for extension of time

As advised in our earlier email, a decision on your FOI request is due by

The Department has progressed your FOI request, with documents collated

Ministers’ Offices. We do however need some additional time to assess and

to review the attached list and consider revising the scope of your
request to a more specific set of QTBs. We can then ensure the revised
scope is agreed and request finalised.
