Under the FOI provisions I request that you provide me with a copy of any delegations schedule/s in use at Finance.

Specifically, I am seeking any schedules wherein decision makers exercise authority under the pieces of legislation, excluding financial and HR delegations schedules.

If this information is already available on your webiste or elsewhere, please point me to where I can find these schedules.

Do you have any particular legislation that you are interested? The request is very broad as Finance administer numerous legislation. If you limit your request to the legislation you are interested in, it'll be easier for Finance to process your request.

Specifically, if the staff of the Department of Finance make delegated decisions under a particular Act in their day-to-day work, is there a Delegations Schedule that lists their position number and the delegations they hold?

Delegations are usually done on an Act by Act basis (as you can see from the publically available instruments). We don't have a specific schedule for individual staff. If you want to FOI every single delegation instrument, it would be quite a resource intensive exercise. Are there any areas of topic that you are interested to narrow the scope?

The Administrative Arrangements Order lists out all the legislation that the Department administers. https://www.dpmc.gov.au/parliamentary/do...

You can have a look at the above to see what you are interested in. I note that not every legislation requires a delegation. Also, there are other legislation that are not listed that will require a delegation such as HR and financial.

Dear FOI Requests,

I do want to go ahead with the request, but I'm not sure how to word it. Essentially what I really want to know is whether your delegation schedules are based on position numbers or levels. That is, do individual staff hold delegations because of their position, or are delegations broadly applied to staff at level.

Your request as currently worded is unlikely to be processed, given the sheer number of legislation that we administer. It is likely an unreasonable diversion of resources to process your FOI request.

Thank you for your email to the Department of Finance (Finance) requesting

In an email dated 6 November 2014, you revised your request to:

 

Under FOI please provide copies of the Delegation Schedules for these
items of legislation -

 

Commonwealth Electoral Act 1918

Commonwealth Electoral Legislation (Provision of Information) Act 2000

Commonwealth Funds Management Limited Act 1990

 

The statutory period for processing your request commences from the day
after Finance received your request.  Your request was received by Finance
on 29 October 2014.  The processing period may be extended if we need to
consult third parties, impose a charge or for other reasons.  We will
advise you if this happens.

 

Liability to pay a charge

You will be notified of any charges in relation to your request as soon as
possible, before we process any requested documents or impose a final
charge.

 

Publication

As required by the FOI Act, any documents provided to you under the FOI
Act will be published on our [1]disclosure log, unless an exemption
applies or the documents are characterised as containing personal
information.  Documents will be published within one working day after
they are released to you.

 

Policy to exclude junior departmental officer contact details

Finance has adopted a policy to generally exclude the names and contact
details of junior staff (non-SES officers) from any documents released
under FOI. Finance’s preference is to reach agreement with FOI applicants
to exclude these details from the scope of the request. Where there is no
objection, the names and contact details of junior officers are redacted
under section 22 of the FOI Act, on the basis that these details are
irrelevant to the request.
