Secure Right of Way over a reserved road

Dear Tasmanian Crown Land Services,

I am interested in purchasing a piece of land without frontage to a Council maintained road.
The address of the land is 1306 Eldon road, Tunnack.
To be able to build on the lot I would have to secure permanent legal means of access to the site. There is a Crown reserved road on the northern side that extends through to Eldon Road, just opposite Gettington Road.

There is currently a Crown licence over this – not sure if that is to this property or not. I would like to secure Right of Way over the reserved road as a lease/licence from Crown is not permanent.

Would this be possible?
What would be my options for solving this issue?

Hello Jason,
In response to your below enquiry, the owner of 1306 Eldon Road, Tunnack
(CT 19577/1) can apply to purchase a Right of Way (ROW) over the adjoining
reserved road (Crown land), that provides access to Eldon Road, using the
linked [1]application form.  The completed form can be lodged at any
Service Tasmania shop, along with the application fee of $526.50 .
A ROW is permanent legal access to a property and is required by some
councils for development of a parcel.  If you have not done so already, I
would seek advice from the Southern Midlands Council regarding access for
development.

 

For your information, I have also linked the [2]Guide
Sheet to Applying to Purchase Crown Land.

Please note that an application to purchase a ROW can only be accepted
from the owner of a property adjoining a reserved road, as the ROW, if
granted, needs to be recorded on the title of the adjoining property.
